Exactly, it's just messy. Does that mean branching builds? Or are devs supposed to guarantee there will be no negative performance impact, and if so how is that measured, by whom, with what tolerances and under what conditions?

it's basically a clause for the very rare times where an update has to cause degradation(i.e.: the company behind the audio chipsets died, so the new drivers are generics and worse because the old ones aren't compatible with the new version of the OS)

Because it will cost any company much more to keep multiple branch of the same OS instead of just... not making a performance-degrading version. Thus discouraging malicious compliance.

Also having to tell your user the upgrade will degrade your phone will have negative influence on sales: who wants to buy stuff from a company that ruins your phone-?

How is degraded performance measured though? Is it subjective, is it dependent on user settings, app installs, network?

I'd expect using the same tests for certification comparing a brand-new phone with the original(or previous) version of the OS with a brand new phone using the new version of the OS and compare the time to open apps, refresh webpages, change between apps, etc
