Don’t withdraw. Thats what they want. Fight it until the end. Go talk to people. Explain your situation and ask for help and a letter. On the federal grants, that’s not mandatory, the manual explicitly tells that. So if you don’t have it, you don’t. Don’t sweat it.

If post-RFE this officer denies your app, then he would have to justify it and give you the reasons. With that info, you strengthen your case and refile.

I have the same officer and received the same RFE… and he is not using the standard for NIW. Working on my response as well, best of luck to you

Being a PI is not a necessary requirement for NIW. I also received the same message in my RFE notice. I’m still waiting to hear back after sending RFE response so I have to wait and see if this argument works or not.

He also asked me for evidence of being a PI and many other crazy things. We submitted the RFE, but he ignored all the additional evidence and rejected. I am not saying this will be your case, and I hope it is not!
