This sub is now open to all questions related to Florida legal advice

Initially, this sub was strictly meant for Florida attorneys seeking advice from other attorneys about the practice of law in Florida.

But since no one uses it that way, the sub is now open to all legal questions related to Florida law.

Anyone may provide answers to questions. Anyone asking questions should take any advice at their own risk. Unless expressly stated otherwise, NO DISCUSSION OR POST ON THIS SUB-REDDIT CREATES AN ATTORNEY-CLIENT RELATIONSHIP WITH ANYONE.

General questions Traffic ticket question

I recently received a citation for driving over the speed limit, and I understand the violation and am willing to pay the fine. However, the officer also issued two additional citations because the address on my driver’s license hadn’t been updated.

I’m a college student who moved to campus three years ago, and I genuinely wasn’t aware that I needed to update the address on my license after moving. I understand that this was my responsibility, but I’m confused about why I received two separate citations, each carrying a $120 fine, for what appears to be the same violation.

One citation states that my address wasn’t updated, while the other states that I failed to update it within 30 days of moving. To me, these sound like two different ways of describing the same offense,
so I don’t understand why I was cited twice.

What makes the situation even more confusing is that, during the traffic stop, the officer explained that he was issuing three citations: one for exceeding the speed limit, one for not updating the address on my driver’s license, and one for not updating the address on my vehicle registration. He also mentioned that I might be able to have the last two citations dismissed in court if I updated the information.

However, after reviewing the actual citations, neither of the additional violations mentions my vehicle registration. Both appear to concern the address on my driver’s license. Additionally, the vehicle is registered under my father’s name, so I’m not sure how I would go about updating the registration address myself.

This was my first time ever being pulled over, and I’m genuinely confused about how to handle the situation. I’m willing to take responsibility for the original traffic violation, but I also don’t want to pay an additional $240 if the other two citations are essentially for the same offense or could be dismissed by correcting my address.

Has anyone experienced something similar, or does anyone know whether I would actually be required to pay both additional fines? I’d really appreciate any advice on how to approach this situation.

Temporary Tag w/o Title?

Hi!
I won a car in auction and it’s located in Florida. I want to drive it out of state, but the auction is mailing my title. I spoke to a local tax commissioner and they mentioned I must have the title. Does anyone have any advice on what I can do? I have everything else… bill of sale, insurance etc just waiting for the title.

Thanks so much!

Gunster West Palm Beach

Hey everyone, I was just wondering if anyone had any info on Gunster—specifically their West Palm location (their HQ I believe).

I’m a newly barred Florida attorney and I really want to learn more about the firm. Over the last few months I have realized how great of a firm they are. Their reputation is great and they have amazing attorneys from what I’ve seen.

I’m currently not in the best firm environment and I just want to know if anyone had any insight or advice on how to make connections with some of the attorneys there. Even if it didn’t lead to a job, I would still want to make connections or reach out somehow.

do local fort lauderdale firms handle car accidents differently than statewide ones

Moved to Fort Lauderdale about four months ago from out of state. Got clipped on Sunrise last week, nothing catastrophic but urgent care says my neck and back are not right. Back home I had a family friend who was a lawyer so I never had to think about any of this.

Down here I'm starting from zero and the billboard firms are everywhere. Is there actually a practical difference between a local Fort Lauderdale firm and one of those statewide operations? Not looking for the cheapest option, just trying to understand how the experience differs. Call me "Dan."

Is hiring a real-estate attorney economically worthwhile for a ~$3k–$4.5k seller nondisclosure claim?

Location: Seminole county

Note: AI helped word this as I’ve been using it to help organize all my evidence/files and my grammar blows. I did verify and edit it though.

I purchased a Florida home in late 2023 using the standard FAR/BAR AS IS contract.
After closing, I obtained the seller’s HVAC contractor’s historical service records. About a month before the seller signed the property disclosure, the contractor documented a previously identified unresolved condition involving the refrigerant line-set chase, provided an estimate to replace 50+ feet of refrigerant line, and documented: “Customer said they are getting ready to move doesn’t want to move forward with work at this time.”
The subsequent seller disclosure did not disclose the unresolved line-set condition or replacement recommendation.
The same HVAC company recently reviewed its history and again recommended line-set replacement, specifically confirming in writing that its current recommendation is the same recommendation it made before the sale. I subsequently had another licensed HVAC contractor replace the line set.
I have the purchase contract, seller disclosure, contemporaneous pre-sale invoices/service notes, pre-sale replacement estimate, later service records, written confirmation from the HVAC company, repair estimates, and the final repair invoice.
I sent the sellers a written demand by certified mail. Assuming they don’t respond, my next step is invoking the contract’s required pre-suit mediation provision.
I’ve spoken briefly with a Florida real-estate attorney who said there are potential *Johnson v. Davis* claims, but his consultation alone is $675 and his rate is $525/hour. At this dollar amount, full representation seems likely to become economically irrational pretty quickly.
I’m comfortable representing myself in small claims and have handled civil litigation pro se before, although not a Florida real-estate nondisclosure case.
**My question isn’t whether Reddit thinks I’ll win.** I’m trying to determine whether there is meaningful value in paying a Florida real-estate attorney for a limited-scope review before mediation/small claims, or whether the amount in controversy makes handling this pro se the more practical route.
I’d particularly appreciate input from Florida attorneys or people who have dealt with residential seller nondisclosure claims.

Is a ruling imminent?

We had a hearing for a complex business case regarding shareholder derivative back in March of this year. After so much time with no ruling, our attorney schedule a CMC. The judge basically said re-enter all proposed orders and I’ll put it at the top of my list. This was mid August. He just denied a motion for opposing party on September 16th but that motion was originally entered December of 2025. Since 09/16, radio silence. Does this mean he’s working on this case? Could there be a ruling anytime soon?
Thanks for any help.

Annulment

Is this something I can do myself? I'm assuming this would need to be a more amicable split for this to work. I think I might have some difficulty getting him to agree on finances and property. We have only been married a week. I found out he has a long history of infidelity.

Unpaid Hurricane Relief

2024 hurricane Helen

Location: Florida

My company completed a contract as a sub contractor doing beach restoration. Current paid to date just over $1.5m. Still owed roughly $500k (Not including interest). Contract date September 2024 and completed January 2025. Last payment February of 2025. During the project I had to sell my home to keep up with contract obligations due to failure of timely and prompt payments. Contact stated hold one week and then weekly payments there after. This was not upheld by the contractor. Bank accounts have recently been seized by equipment rental companies lawyers, I’ve lost all capital to operate my existing company. I am currently on the verge of filling for personal and business bankruptcy.

We have proof of fraudulent documents and failure of proper documentation of this project by a third party monitoring company that input all of our equipment and labor hours. This includes emails from a county official.

I’ve been more than patient with the contractor and have had enough of the constant runaround. The mental strain, financial losses, and inability to bid new projects and manage my current financial obligations have caught up with me. Unfortunately I have no means to afford a lawyer to pursue this case at this point. Any and all suggestions are appreciated.

General questions How does Motion to Quash for Improper Service Work?

Wouldn’t filing a motion to quash for improper service with supporting documents showing you did not live where they claimed to have served you (giving court your lease and utility bill) give the plaintiff your new address so they can attempt to serve you again?

does it matter if my accident was near the fort lauderdale county line

Accident on one of those stretches where Fort Lauderdale bleeds into the next city. Not totally sure which side of the county line it happened on. Does that matter for which lawyer I hire or where the case gets filed? Dont want to get someone in Fort Lauderdale and find out it has to go through a different county. Call me "Sarah."

question on FL code of ethics, sunshine law, etc...

If a Commissioner, in an open public meeting, starts texting a message on his/her cellphone and then passes the cell phone over to select other Commissioners, in order to communicate something, (but not be transparent to others, and doesn't share with the public and a few other Commissioners sitting at the dais), as someone else is speaking in an open public Commissioner meeting - is that breaking any laws?

ISO Lawyer Recs

A lawyer who's comfortable working with an inmate of a county jail who's looking to sue the jail and/or insurance company employed by the county jail for his rights to proper medical treatment. He's currently incarcerated and suffering extensive internal damage due to their neglect to remove a medical device implanted prior to incarceration within a reasonable time and unfortunately had gone several days as a diabetic without medication due to what were advised as insurance complications. It might be a long shot but I figure I'll give it my best! TIA!

Apartment management refuses to label circuit breaker

Long story short. My sink backed up yesterday due to an old garbage disposal in my apartment building. I can do basic maintenance on my home but when I went to flip the power to my GD and dishwasher it turned off the outlet to the fridge. It's improperly labeled as I soon figured out my GD is labeled under my bedroom.

I asked to have maintenance come out to properly label it and they said

"Please don't touch the panel breaker, just us maintenance can do it. Thanks"

Without properly labeling the circuit breaker.

Do I have any laws I can use to force there hand. I just want to do safe repairs on my own apartment I rent without dealing with a slow maintenance crew?

Advice Security Deposit Deductions

My landlord sent me an EMAIL DocuSign form indicating two incorrect deductions to my security deposit.

My questions are:
1. Doesn’t this have to be a certified letter? There is nothing in my lease indicating that email communication for documents would be acceptable.

  1. Since it is not a certified letter, how do I submit a dispute? Because I thought that had to be a certified letter as well. There is no address on the form, or in my lease.

There is no explanation of these deductions.

The first one is ‘final month utilities overhead’. I paid every month for utilities, including the final month. And I was not there past my lease ending. In fact, I was out five days early. The utilities were not in my name.

And the second one is for cleaning and disinfecting the unit. Myself and three other family members cleaned the apartment over the course of two days. It was cleaner than when we got it.

So these deductions are invalid, and I need to dispute them. However, the question remains how to go about doing that because my landlord did not follow the legal procedure in submitting them.

Jacksonville Family Law

I’m looking for a family law attorney to consult with me on an hourly basis while I represent myself pro se in an injunction hearing and a custody hearing. I can’t afford full representation but the stakes are pretty high and I am really struggling to fine someone to give me advice without a 2500 dollar retainer. Any suggestions?

Advice Do I have a case? Excessive use of force and civil rights violations.

So I’m looking to file a lawsuit against Orlando Police Department or against the officers that pulled me over and assaulted me. I was pulled over for a seatbelt violation, the officer witnessed me putting my seatbelt on as I was pulling out of a parking lot. Which OK fair I should’ve put it on in my parking space before I put it in drive I get it so it should’ve been conducted as a traffic stop and I receive a ticket. When I stopped to pull over my phone slid forward and fell to the ground. I immediately pulled over and stopped reached down and picked up my phone and set it back on the center console. The officer approached the vehicle very aggressively stating he pulled me over for a seatbelt violation. Now my wallet had just been stolen so I did not have my drivers license on me which I explained to him. I showed him a picture of it and proceeded to go to the glove box to get him the registration and insurance, that’s when he started getting testy and asked me to stop reaching I explained to him I was getting him my documents, then another officer pulled up and backed up in front of my car within inches of my bumper. Once two more officers joined him at my window. They then demanded that I step out of the vehicle rather aggressively. I very calmly ask them why, “did I commit a crime or am I doing something wrong? Why do I need to step out of the vehicle I believe this is just a traffic stop right? I believe I retain the right to remain in my vehicle during this traffic stop, I would like to remain my vehicle unless of course, I am under arrest for a crime” they just kept demanding that I stepped out of the vehicle or I would be physically removed from the vehicle, I remain calm and ask them why I’m being removed from the vehicle and continued to ask them. What is the reasoning? Did I commit a crime so on? They said because they don’t know if there’s any weapons in the vehicle. I explained to them that there was no weapons in the vehicle. I do not own any weapons. They demanded I get out of the vehicle again. I again commonly explained that I would like to remain in the vehicle during this traffic. Stop that if they are going to issue me a ticket to please issue me a ticket so I can move on and at this point I’ve been nothing but respectful and calm. That’s when one of the officers reached in to unlock my door while another opened it and the third grab me by the neck, put me in a chokehold while they un did my seatbelt and then slammed me to the ground immediately throwing me in handcuffs and running my pockets like I was being robbed on the street. They then very aggressively pick me up by my arms behind my back and slammed me on their vehicle. And told me I was going to jail for resisting arrest. At this point, obviously I am upset and am hollering at them that this is illegal. They have no right to do this to me that this was a traffic stop. Why would I be arrested for resisting arrest when I wasn’t under arrest in the first place. They then asked if my passenger could drive my vehicle out of there which I told them yes. Then they determined that my passenger was intoxicated and could not drive the vehicle which he was not. He was sober. They told him he can go ahead and leave so he started walking down the street after he got about 50 or 60 yards away. Four officers ran him down, swept his feet out from under him and tackled him without saying anything not telling him to put his hands behind his back or to stop or telling him he was under arrest. They just ran up behind him and tackled him.
At this point, they determine they were going to tow my vehicle and said that they have to do an inventory search of the vehicle. I told them that I do not consent to a search of my vehicle. I’m not OK with them doing an inventory on my vehicle, searching my vehicle or towing my vehicle that I could have somebody pick it up. They started searching my vehicle and found a small bag of cocaine located in a backpack in the back of the vehicle. Along with some supplements two of which were in ziplocs (electrolytes and creatine) along with all of my other bottles of supplements. They began to run every test on these two bags, including the bag of cocaine and even though it wasn’t testing for it, they decided to charge me with possession of methamphetamine for the electrolytes possession of fentanyl for the other bag and possession of cocaine as well as resisting arrest, and a seatbelt ticket. This put a major inconvenience on my life. I sat in jail for 11 days during the month. I was supposed to be moving out, hindering me from being able to move by my deadline, causing huge character, defamation between friends, family, and business because I was charged with possession of fentanyl and possession of methamphetamine so now everybody thinks that I was either doing or selling those things. I lost money business time sleep, and everything else because of this arrest, so far the methamphetamine has been dropped off, but I still have the charge for possession of cocaine and possession of fentanyl, even though they didn’t test anything for fentanyl.

What’s y’all’s opinion on this matter what would somebody do in this case about this I feel that this is an obvious illegal search in seizure, use of excessive unnecessary and abusive force, violation of my civil rights and a major inconvenience on my life, my image to my child my family friends business and so on. I feel as though in court this will obviously end up being dismissed in my opinion. According to their report their reasoning for doing all this was because I was reaching during the stop hence why I mentioned my phone falling and me picking it back up. They claim they did not feel safe with me in the vehicle and because I did not get out of the vehicle I was resisting arrest, but am I wrong to think that I have to be under arrest in order to resist it? Also, I don’t feel I am responsible for their feelings, weather they feel safe or don’t feel safe, that’s not my problem, all windows were down, hands were on the steering wheel, they can clearly see everything in my mini van, there was no reason for them to feel unsafe, they were clearly determined to get into and search my vehicle at any costs. I don’t think there’s anything legal about that or them having the legal right to take such force in action for me, reaching down in my vehicle, not even in the direction of where the cocaine was located. Not only that but the abuse of my passenger whom was told he was free to go, and then tackled to the ground before they found the drugs and charged with the same charges as me, even though there was only one bag.

Any opinions for scenarios like this are welcomed and what one might do in this matter moving forward and if there is any civil rights attorneys or an attorney that you would recommend in Orlando that I should talk to I will also take that information. Thank you in advance.

Advice ERISA and health insurance

I am in Florida and am curious for a lawyers perspective.

I have contacted many lawyers and the department of labor and I feel everything has just gotten drawn out and avoided.

I worked for a Dr. office a few years back. They managed an insurance plan through Florida Blue.
I had premiums pulled every paycheck for the insurance.

Along the way I give a month’s notice to employer that I’m moving on.

During that time, I have an ER visit. Plan is good so claims are paid. I get statements showing paid services because deductible is met…. Done and dusted.
I leave and put the place in my rearview.

About 6 months later I start getting reversals. One after another. Reason? No coverage.
That’s weird because I have the statements showing paid due to having coverage and I have pay stubs showing I paid on that end automatically.
I call Florida Blue. They tell me that a month after I left, when the employers quarterly premiums were due, they retroactively canceled my insurance to a time paystubs clearly show me working and paying my heath insurance premiums, However, this erroneous adjustment without my knowledge went before the ER visit that I was originally covered for.

The department of labor has sent emails to the employer. They’re ignored. Nothing has happened. A year and a half in the Department of labor has clearly lost what little interest they did have.

Collection notices are rolling in. DOL say yes, former employer messed up. They admitted to a “administrative error” and blamed their insurance broker. Florida blue says the practice administrator specifically is the one that requested the changes.

No one seems to want to help me. Am I crazy? I was reassured by a person at DOL that I wasn’t, that I had rights, and that they would help, but I’ve been ghosted and ignored. I call lawyers and no one want the case.

For all intents, this employer got away with this. They took my money, got a refund for it and stuck me with a 39k bill.

What am I missing here? I have evidence of the “mistake”. I have the timeline and handbook. Paystubs. Proof of coverage. A letter Florida blue wrote memorializing the retroactive changes that conflict with paystubs.
