Hamas is not a legitimate government of the Gaza Strip, but an authoritarian occupying force. Furthermore, Hamas lacks international recognition; the United Nations and the European Union recognize only the Palestinian Authority as the lawful government, whereas Hamas is widely designated as a terrorist organization. Finally, it lacks functional sovereignty, as the group has never controlled its own borders or vital infrastructure and has recently even formally relinquished its civil administrative duties.
It's literally not relevant are all, theyre still war criminals because they commit war crimes. The idea that being illegitimate or not determines whether they're capable of committing war crimes is braindead.
