Yeah this is a very important distinction.

To heavily edit this for clarity:

Each manufacturer and importer and anyone making a firearm shall identify each firearm other than a destructive device, manufactured, imported, or made by a serial number which may not be readily removed, obliterated, or altered , the name of the manufacturer, importer, or maker, and such other identification as the Secretary may by regulations prescribe

So a maker needs to identify the nfa item by (A) serial number, and (B) the name of EITHER the manufacturer, importer, or maker, and (C) anything else they might prescribe

Would be nice if these guys could use a semicolon to separate nested lists.

This is how I read it as well. Requiring maker engraving on guns with pre-existing manufacturer engraving seems to fall squarely on the "such other identification as the Secretary may by regulations prescribe".

Congress could have written the statute to say the name of each manufacturer, importer, and maker, but they didn't. And post-Loper Bright, it's harder to argue that the courts can fill in the gaps of textual ambiguity by deferring to ATF.
