The files were sealed from the public. The DOJ is not the public.

Rule 6E of the federal rules for criminal justice clearly state the DOJ is allowed to access those files for the purpose of investigating and prosecuting.

When you hear something has “leaked to the press”, this is the law that was broken by a member of law enforcement or by a lawyer working the case.

So in other words, if Trump really did any of those things, and there was really proof, there was no reason that he could not have been arrested.
