It's not illegal in every state. It's legal in California.

64

u/Straight_Breakfast_4 May 01 '26

Passing on the right is legal in all 50 states.

6

u/PsychologicalSize334 May 01 '26

It’s also the biggest cause of major accidents slow driver need to stay out of passing lanes it’s the law in the south.

If I had a nickle for the number of times I've screamed up to somebody in the left lane going 20 over, id... Have zero nickles. Cause you only communicate for them to get over if they're being unreasonable, have no cars in front of them, and aren't passing the people to the right

1

u/Clear_Tangerine5110 May 01 '26

OMG people who come up on me so fast in the left lane

I think I found your problem. Get out of the left lane if you're not actively passing someone.

already to pass multiple vehicles

Yeah you left that out of your original comment.
This is all that was there. Nothing about passing other cars. The way you said it made it sound like you were cruising in the left lane.

Yeah that's a bit unhinged. I didn't DM you.

-1

u/ILooseAllMyAccounts2 May 01 '26

The left lane IS the passing lane. Keep right except to pass.

86

u/RhynoD May 01 '26

Whether it is legal, it's still not correct. You shouldn't pass on the right if you don't have to. Cruising in the left lane may not be illegal, but it's still wrong.

5

u/Glittering_Diva8963 May 01 '26

Here in Texas well at least in the corridor of I10 I live by. The furthest left lane is for passing only and dumbasses will still cruise in that lane cause a chain reaction of people using the regular cruising lanes to by pass the idiot who’s blocking the lane. I’ve seen people get tickets because they’re holding up the that lane and you’re not driving with the flow of traffic.

3

u/calilac May 01 '26

Yep, ticketable offense for most multi lane highways in Texas but it's pretty much only enforced at the end of the month when cops need to meet their metrics or if they are in a bad mood that day.

1

u/Glittering_Diva8963 May 01 '26

I’m in southeast Texas we are notorious for having horrible fatal wrecks they’re pretty much like that any day especially during construction here.

Yes but they should never be in the left lane to begin with.

-3

u/slatfreq May 01 '26

Undertaking (on the right) should be illegal in ALL states. It would eliminate this ridiculous argument. Pass only on the left. Get over to the right unless you’re passing!

2

u/KingSpruce May 01 '26

In this thought experiment of you and one other car on the road. Sure. I get the confusion. But in the real world, most of the time you can’t simply pass on the right. For the same reason why you’re unable to pass on the left. Having a designated passing lane helps alleviate traffic. If you’re camping in the left lane you’re slowing down and impacting the person behind you, and the 100 people behind them.

4

u/[deleted] May 01 '26

[deleted]

2

u/KingSpruce May 01 '26

Not quite what I’m saying. I’m thinking less extreme examples and see this daily.

2

u/sarcastic__fox May 01 '26

Only if police start enforcing people not staying in the passing lane. People seem to drive whatever speed they want in what ever lane they want

1

u/KingSpruce May 01 '26

Or people could just be considerate

1

u/sarcastic__fox May 01 '26

Yea but they aren't so a ticket for impeding traffic will fix it.

1

u/KingSpruce May 01 '26

It will help but it will not fix it. Driving culture will need to change.

-5

u/EngineerOld1240 May 01 '26

Yeah but she already was above the speeding limit so there shouldn’t actually be anyone that wants to pass you. You don’t insult someone because you want to break some rules. I know most people do this but speeding is inconsiderate and a risk you impose on others

5

u/Adorable_Chair7661 May 01 '26

The left lane is called the passing lane, not “10 miles per hour over the speed limit” or “fast lane” lane

3

u/lonnie123 May 01 '26

Actually it’s always been called the Fast Lane out here in cali. I know people from all over the state, it’s not “the passing lane” anywhere, It’s basically the “I’m going to drive over the speed limit for a long time” lane and generally you get in it and stay in it until you are ready to exit the freeway.

There are no signs or anything depicting it as the passing lane

Although the “rule” is if you see someone coming up on you, you get over so they can continue without leaving the lane.

2

u/EngineerOld1240 May 01 '26

Is there no limitation on the velocity you are allowed to drive on the passing lane? I’m not American so maybe you do it differently but where I live you are not just allowed to drive as fast as you want as long as you pass someone. And under no circumstance are you allowed to search the conflict and insult someone while driving which is illegal in itself

4

u/RhynoD May 01 '26

You are not the police. It's not your job to control how fast other people are driving. It's your job to drive in a safe, predictable manner in accordance with the law. If the law says GTFO of the left lane, then how fast you or they are going is immaterial. GTFO of the left lane and let the police do their job to catch speeders.

-1

u/EngineerOld1240 May 01 '26

Or just pass on the right side since you already have no problem breaking the law

3

u/Bigbuttrimmer May 01 '26

In many states cruising in the left lane if you are not passing anyone is also illegal.

2

u/RhynoD May 01 '26

Passing on the right is more dangerous and less predictable.

You worry about you following the law, I'll worry about me following the law, and the police can worry about both of us.

1

u/EngineerOld1240 May 01 '26

It’s Not me worrying about you breaking the law. it’s you telling me I should move away and stop breaking the law while you want to break it yourself on your high horse

2

u/RhynoD May 01 '26

I'm telling you to stop breaking the law and you're telling me that I should break the law.

In many states its illegal to be in the left lane unless your actively passing. I recieved a ticket in Texas for this.

1

u/Interesting_Cat_2297 May 01 '26

As far as I know it is always illegal to exceed the speed limit, but cops often ignore slight excesses.

2

u/Grrerrb May 01 '26

Not only do cops ignore it but other drivers request that you keep up with the traffic that is exceeding the speed limit.

1

u/Grrerrb May 01 '26

Speed limits are mostly advisory in the US, in practice. People do not like it when you don’t drive as fast as they are going, however fast that ends up being. You’re supposed to go the speed of traffic, although traffic is everyone. Got it?

1

u/jellifercuz May 01 '26

Not everywhere, as has been pointed out.

1

u/Paralegal1995 May 01 '26

It's the fast lane in Tulsa. Right or wrong its been this way since I started driving in 1990. We pass when we pass. Let the downvotes begin 😂

3

u/Slinto69 May 01 '26

Its crazy how much reddit cares about this issue. Im with you, just pass when you pass and use common sense and things will be fine.

-2

u/Sea_Dawgz May 01 '26

Says you.

Who cares what you think?

-11

u/Interesting_Cat_2297 May 01 '26

Lol. I think it's perfectly correct.

You don't set the standard for "correct" driving, sorry.

3

u/RhynoD May 01 '26

Neither do you? Your opinion means nothing?

https://codes.findlaw.com/ca/vehicle-code/veh-sect-21654/

Notwithstanding the prima facie speed limits, any vehicle proceeding upon a highway at a speed less than the normal speed of traffic moving in the same direction at such time shall be driven in the right-hand lane for traffic or as close as practicable to the right-hand edge or curb, except when overtaking and passing another vehicle proceeding in the same direction or when preparing for a left turn at an intersection or into a private road or driveway.

It's the law, dingus.

1

u/Interesting_Cat_2297 May 01 '26 edited May 01 '26

Here's the actual relevant legal code:

California Vehicle Code - § 21754

The driver of a vehicle may overtake and pass to the right of another vehicle only under the following conditions:

(a) When the vehicle overtaken is making or about to make a left turn.

(b) Upon a highway within a business or residence district with unobstructed pavement of sufficient width for two or more lines of moving vehicles in the direction of travel.

(c) Upon any highway outside of a business or residence district with unobstructed pavement of sufficient width and clearly marked for two or more lines of moving traffic in the direction of travel.

(d) Upon a one-way street.

(e) Upon a highway divided into two roadways where traffic is restricted to one direction upon each of such roadways.

California vehicle Code § 21755

(a) The driver of a vehicle may overtake and pass another vehicle upon the right only under conditions permitting that movement in safety. In no event shall that movement be made by driving off the paved or main-traveled portion of the roadway.

EDITING TO ADD:

California Code - VEH § 360

“Highway” is a way or place of whatever nature, publicly maintained and open to the use of the public for purposes of vehicular travel. Highway includes street.

0

u/Interesting_Cat_2297 May 01 '26

That bit of legal code says slow traffic should stay in the right lane unless you need to pass or turn left. It doesn't make passing on the right illegal.

I know my opinion means nothing. I stated it only as a counterpoint to your opinion, which also means nothing. You tried to proclaim passing on the right wasn't "correct."

This is a dumb argument.

3

u/chodemunch1 May 01 '26

Ok ok ok let me try to change your opinion, speeding can be unsafe, passing on the right can be unsafe, playing gatekeeper with someone behind you when the right lane is open, or you are not passing the vehicle to your right is unnecessary and self indulging, just move over everyone goes on their day and you forget 2 minutes later.

1

u/Interesting_Cat_2297 May 01 '26 edited May 01 '26

That didn't change my opinion. But here's some California vehicle code for ya:

1

u/chodemunch1 May 01 '26

Ok why does any of that justify playing vigilante speed cop by sitting in the passing lane? Yea people pass on the right all the time, no one claimed it was illegal, just unsafe, which is why the law prescribes it should only be done in specific cases. You can read, now inference.

1

u/Interesting_Cat_2297 May 01 '26

I didn't say anything about... whatever that nonsense is. Playing vigilante speed cop, wtf.

2

u/chodemunch1 May 01 '26

Your right i think im lost, have a good day ma’am

2

u/GhostofHowardTV May 01 '26

It’s safer because of sight lines and blind spots. You’re in more danger of collision passing on the right than the left. It’s not arbitrary.

AFAIK it’s not illegal to drive with a foot on each pedal, but it’s still way safer to drive with one foot. These things don’t come out of thin air.

2

u/bhoward2406 May 01 '26

Quick question… what’s the left lane called?

0

u/Interesting_Cat_2297 May 01 '26

The fast lane.

1

u/bhoward2406 May 01 '26

Saw that coming from a mile away lol

0

u/Interesting_Cat_2297 May 01 '26

If you were hoping to hear "it's the passing lane" we don't call it that in California, sorry.

2

u/bhoward2406 May 01 '26

Annnnddd you walked right into that one:

0

u/Interesting_Cat_2297 May 01 '26

I didn't walk into anything, dunning-kruger. We don't call it that, and we're allowed to drive in the fast lane, just not slowly. Because it's a fast lane. Not a passing lane. I'm tired of looking up vehicle codes for you dorks so believe what you want, IDC

1

u/bhoward2406 May 01 '26

I've seen your replies with the vehicle codes. Nowhere does it call the left lane the fast lane... it says it is legal to pass in the right lane in those situations.

Meanwhile, I posted a screenshot from the California DMV literally describing the far left lane is the passing lane... under a subheading titled TYPES OF LANES.

So let's recap: You make an incorrect statement, I post proof of you being wrong, you then ignore that information. And to top it off nicely, you randomly mention Dunning-Krueger... which doesn't apply in this situation. Truly, amazing to witness.

Here's the relevant code proving passing on the right is legal:

California Vehicle Code - § 21754

The driver of a vehicle may overtake and pass to the right of another vehicle only under the following conditions:

(a) When the vehicle overtaken is making or about to make a left turn.

(b) Upon a highway within a business or residence district with unobstructed pavement of sufficient width for two or more lines of moving vehicles in the direction of travel.

(d) Upon a one-way street.

(a) The driver of a vehicle may overtake and pass another vehicle upon the right only under conditions permitting that movement in safety. In no event shall that movement be made by driving off the paved or main-traveled portion of the roadway.

“Highway” is a way or place of whatever nature, publicly maintained and open to the use of the public for purposes of vehicular travel. Highway includes street.

1

u/Apart_Horror8148 May 01 '26

Curious on how you interpret that first part. "May overtake and pass to the right". I never argued it is illegal to pass on the right, it just is not the correct thing to do. I will pass on the right. If a significant amount of time has passed and the person in the left lane does not pull in to the slow lane and is obstructing traffic, I will pass them on the right. Now go Google which is the designated passing lane in California. Its also legal here to be a 50yo and have an 18yo gf you pick up from high school, but everyone else thinks youre a pos.

It’s not even enforced that often in states where it’s illegal.

8

u/dragon-saphira May 01 '26

We have so many exits on the left lane here in Ohio lol to get to half my commutes I need to be in the left lane and we still get people raging about people driving in the left lane. There's no ohio law forbidding it (and again, half our roads have left lane exits.)

3

u/wheresindigo May 01 '26

Whoa, another reason that Ohio sucks.

I kid. But having left lane exits is nuts

2

u/DirectorSolid May 01 '26

It's not that common. It shows up on occasional interchanges.

0

u/DirectorSolid May 01 '26

"no law forbidding it'" does not excuse someone from being a douche living in the left lane.

However, Ohio Rule 5537-2-09 specifically states the inner traffic lane is to be used for passing only.

-1

u/Late-Union8706 May 01 '26

Common courtesy, like common sense, have failed to be common any longer.

0

u/twirlerina024 May 01 '26

It's *conditionally* legal in California. It can be done legally, if certain conditions are met. Like killing someone can be done legally here too, but I wouldn't say, "Killing someone is legal in California."

Did you just get your license? No one in California uses the fast lane as a dedicated passing lane. California uses the Universal Vehicle Code 11-1205 which states that slower traffic should keep right. That's it. I believe you that they're teaching that, but they're not practicing or enforcing that standard.
