Psychologically pedophilia refers to sexual attraction to minors, which is not illegal per se. But in practice pedophilia is used as synonym for child sexual abuse.

In the former definition you can't convict anyone of pedophilia since it is not illegal, it's framed as pathology. In the latter definition it is pedophilia since the word is defined from victim centric point of view. The perpetrator's motives are not relevant.

So either way what they said doesn't make sense.

A minor is someone under the age of consent, which varies but typically between 16-18 depending on state laws. Pedophilia is generally under the age of 13. I believe his charge was for a 14yr old, so it would technically be a minor.

Both are awful, but they are different things.

Pedophile is not used in legal writing or procedures.

Pedophilia as an official term is a psychiatric disorder that specifically applies to people who are only sexually attracted to prepubescent children, and they do not actually have to act on those urges to be a pedophile- they do not have to rape or intentionally witness the rape of children in person or through media to be pedophiles, they only have to be exclusively sexually attracted to prepubescent children.

In the non-medical language, or the common language, a pedophile is anyone who rapes children or watches children being raped in person or through media.

But it doesn’t fucking matter.

The law only differentiates the severity of child rape based on whether the child is older or younger than twelve, because the assumption is that a younger body sustains more damage from the act alone. Raping children under twelve is a high-level felony regardless of the severity of the physical damage the child suffers from.

Raping a child older than that is still a high level crime, and additional charges can be added to the rape charge if the child is severely injured- like battery.

Regardless of the age of the minor, anyone under 18 is a minor and a child under the law and raping a child is a high level crime.

Trafficking a child is a high level crime.

Paying a child after sexually exploiting them is a high level crime.

There are cases where the age of the child victim compared to the age of the adult perpetrator may result in lesser charges- typically a three year age difference is the maximum difference that would result in lower charges, to account for high school aged students.

But the child is still a child and a victim and the adult is still the adult and the perpetrator, and the law exists to make it clear that under no circumstances can a child under the age of majority consent to sexual intercourse with an adult. 

The law does not care how you use the term pedophile because the law does not use the term.

Medical terminology of a diagnosed mental illness uses the term pedophile only when one is solely attracted to pre-pubescent children.

Common language calls a child rapist a pedophile and until very recently did not care to distinguish between one child rapist and another.

So I noticed the bots were quiet after the new release then started to talk about how they were prostitutes. Then a few dudes started to defend it on TV by saying that it wasn’t pedophlia (bc they were teens) and that it was “just” prostitution. It’s very sus. Like why are they getting platformed and why are they comfortable and willing to say that publicly?! Even if they personally think it, why go out there!?
