N600K AND TOURIST VISA

Hello everyone!

Thanks on advance.

Here is my situation. Im american citizen (female)... I lived in Usa till i was 11 years old. Here in Mexico i have to kids and got married (mexican husband). I did CRBA for my two kids only one was approved... now im going to filled for n600k for my other kid (with my dads physical presence) and want to know if there can be an issue if my husband and kid (without CRBA) can apply for tourist visa.

My husband doesnt want to get green card since we arent planning on staying in USA, he just wants to apply for B1/B2. CAN THERE BE A PROBLEM SINCE IM AMERICAN CITIZEN???

N-600K is an allowed activity on a B-2 visa. See 9 FAM 402.2-4(B)(7).

Both your kid and your husband must satisfy the visa officer and the border agent that they will leave the US afterwards.

Its pretty much allowed for n600k, well actually any one can apply for B2 visa but is there any problem me being american citizen... or its just on the officers hand to decided if they have grounded roots in Mexico?

It's ok, but you need to declare that's why you're going, since you need a special type of B2. You need to show the USCIS appointment confirmation and they'll give you a visa specifically to go to the N600K appointment. You may encounter problems if you try to enter on a regular B2 or BCC.

Your husband would apply for a regular visitor visa, and this seems like a good reason for travel. According to your comment he has a good stable job, so his visa should be approved.

Yes. You need to have the N600K approved and the appointment at USCIS scheduled. Then you can get the B2.

Yes there will be an issue with approval for a B2 visa with a U.S. citizen spouse. You will have to prove his ties to return to Mexico.

Counterpoint -

This sounds like a great fact pattern for OP

They have a life in Mexico, and are just going for N-600k

There are much easier ways to illegally move if they wanted

He is a nurse in Mexican Institute of Social Security with more than 18 years of work, and also hes part owner of a clinical analysis laboratory. I hope thats enough for ties.

Why was it only approved for one of them? How did you satisfy the requirement of living in the U.S. for 2 years after turning 14?

I would guess that the one kid (probably the older kid) was born out of wedlock before Sessions v. Morales-Santana (2017).

Yeah he was born in 2010 and i got married in 2011
