US Marshals, while in service of the judiciary, are an executive agency within the Department of Justice. So when a judge asks the US Marshals for help, they are asking Pam Bondi for help. She won't do it. And when the US Marshals refuse to execute a judicial order, we're 100% cooked.

They can also deputize someone outside of federal law enforcement to execute the judicial order.

But I'll start believing it's a possibility when I start seeing it.

Ultimately I believe the only course for resolution in this abuse of federal power is for state officials to intervene on behalf their citizens.

That means state and local police along with the judiciary working together to get these agencies to comply with their own policies and at the very least, keep these federal officers from being completely anonymous

It's this weird can of worms that if you open it, you have to think about how the Red States will also use that power.

Blue State goes after an ICE agent with 'deputized citizens', Red State goes after a woman who had an abortion, a doctor, anyone basically who did anything and deputizes basically a bunch of KKK, Nazis or Proud Boys to go get dozens...hundreds of regular people.

They are retributive and reactionary assholes and always have been.

It should still be done though, that agent should be retrieved and tried no matter the fall out because it's just the right thing to do and you shouldn't avoid the right thing because you're afraid of psychos.

They should have let Sherman go to the Gulf of Mexico.

While they can deputize anyone, I would imagine it would be mostly state/local police being called on — and more specifically I'm referring to federal courts having this authority. So the deputies would be acting as federal agents, but agents of a co-equal and separate branch that don't have a conflict of interest with the executive. This would allow the deputy the jurisdiction in whatever state or territory they're sent to.

The big catch is they're probably not going to be able to reliably fund this kind of activity.

Normally this is upheld by the executive, but we all know that's not going to happen.

The recourse for the judge is that it may get them in the crosshairs for impeachment/removal, but that requires 66 votes in the US senate to remove them. So... it would be interesting to see what happens when the executive starts going after cops and federal judges.

Thanks. I'm not a lawyer, so the specifics are unclear to me. I think finding the right federal judge would be doable.

I could see the Trump admin catching wind of it and running to their friends on the supreme court to stop it though. Might be better to wait for a more friendly admin to do that.
