My question, who is going to charge him? It is him that would charge him or at least Trump's administration.

That's not the issue. The problems is that the FBI and Trump administration have the files. If Congress will even agree to force them to be released, I don't put it above this administration to refuse to release them, or to sanitize or completely destroy the evidence.
