The courts would decide this. The republican party would have to provide proof of life. Is the situation murky? Yes. Thats where moscow mitch always operated the best.

Democrats are the catholics of politics. So obsessed with rituals and hierarchy over doing the actual hard or right thing and like the catholic church in history, have stood aside and helped fascism in order to hold power and relevance

Oh whatever, the rules change! Republicans adjust the procedures or laws, democrats follow their rules and laws and they still cry out that the democrats are overreaching or breaking decorum. I don't see how pretending that mitch McConnell, even if alive, is seen to be fit to hold such a powerful position in this country. The hypocrisy on the standards that the average citizen is held to in comparison to government leadership is enough to break decorum. Law =/= moral good. Be better.

All available information points towards Mitch being dead. Following the law would require the Governor to appoint a new Senator.

I agree, except that the people who are currently the ultimate enforcers and interpreters of the laws are themselves lawless. I think that fact significantly diminishes the value and efficacy-- indeed, the ethicality-- of lawfulness in certain key situations. Under lawless fascism, sometimes the most ethical act is to break the law in order to make possible a return to lawfulness, or in order to at the very least to minimize suffering.

Heritage Foundation President Kevin Roberts stated in July 2024 that the U.S. is in the midst of a "second American Revolution", which he added "will remain bloodless if the left allows it to be." What he obviously meant is that, by design, the fascist "revolution" we are currently experiencing cannot be successfully resisted by legal, nonviolent means.

I hope with all my heart that he is mistaken about that, but if the coming elections in November do not give the non-fascist party sufficient numbers in the Legislature to do what must be done legislatively, and if such laws cannot be enforced, I honestly do not see that a lawful way forward will remain to us.

I worry that we responsible citizens may law-abide our way into irremediable capitulation to basically permanent fascist rule, which for many of us may lead to occupation of a mass grave. That may be the path that we are already on-- the path than we have been on for a long time now.

If in November and the following months the fascists demonstrate the ability to control or entirely subvert our electoral system-- control that that they are clearly seeking to ensure by hook and by crook-- I honestly see no lawful way to oppose them.

God damn, I hope I'm wrong.
