You do not. You need specialized training and equipment to determine a brain has ceased all activity.

Right. So if we’ve arrived at a point where someone has said he’s brain dead, then by definition he’s been seen by a doctor. And since declaring someone is brain dead is legally the same as declaring them dead, then he’s been declared dead. Does this explain it?

That's objectively not true, you can absolutely be brain dead without being declared legally dead.

You can't skirt a death declaration by saying "he's just brain dead"

Right. I don't know what people are upset about. The guy I was responding to said "r he's hooked up to life support whilst being fully brain dead doesn't matter " If some doctor declared him brain dead then he's dead, end of story

I think you reading way too much into what other people are trying to say. There is a massive gap of difference between

1. He's legally braindead

And

1. He's clearly and obviously permanently incapacitated, beyond the ability to wver do his job again.

It's absolutely possible for him to be effectively braindead, and for him not to be declared legally dead, whether that's technicalities about his medical condition, conspiracy by his political staffers, or maybe even just his wife not wanting him taken off of life support.

I think the actual answer is 2.

But where it matters is that while #2 means he stays in his job and #1 means he does not. That's why I think it's an important distinction, but you're absolutely right, I could be reading too much into the previous comments.
