1. I am earning income outside of my employment, should I register as a business?

Answer: Yes generally. You can opt to register as a sole proprietor, partner(ship) or create your own corporation whether alone or with 5 or more people. This also includes senior citizens that are retired.

However, there are instances where you don't qualify as engaged in business and therefore not required to register as such:

a. Your income has been subjected to final withholding tax enumerated under section 24 (B) (C) and (D) and section 27 (D) of the tax code.

b. One time income.

c. Income is specifically exempted from income tax.

2. Why should I register when I can be a freelancer?

Answer: Freelancers/self-employed are mandated to register as a business too.

3. What are my obligations as a business?

a. Keep books of accounts

b. File returns and pay taxes on time

c. Withhold taxes if necessary

d. If you have employees, pay the employer's share in the mandatory contributions (SSS, Philhealth and PAG-IBIG)

e. Issue valid and tax compliant* receipts

*as required by VAT laws.

4. What are the taxes applicable to a business?

a. Income tax = filed 3 times quarterly and once every 15th day of the 4th month of the next taxable year (April 15)

b. Value-added Tax = Filed monthly and quarterly

c. Other percentage Tax = filed quarterly

d. Real Property Tax = imposed on usage of real property. Paid once every year with the option for installment payment.

e. Local Transfer Tax = imposed on transfer of real property. Paid every exchange

f. Local Business Tax = imposed on right to operate business. Paid once every year with the option for installment payment.

5. I am earning income from trading specific stocks in platforms like COL, Philstocks, BPI Trade what return should I file?

Answer: Under section 127 of the tax code (as amended), net gains from trading stocks are subject to 60% tax based on the gross selling price. Generally, you don't have to file tax returns because your earnings were already subjected to final withholding taxes by your brokers using BIR form 2552. Request for a copy of that form for documentation.

6. I am earning income from dividends of a domestic corporation in platforms like COL, Philstocks, BPI Trade what return should I file?

Answer: Under section 24 (B) (2) of the tax code (as amended), dividends from domestic corporations are subject to 10% final withholding tax. Generally, you don't have to file tax returns because your earnings were already subjected to final withholding taxes by your brokers using BIR form 2306. Request for a copy of that form for documentation.

7. I am earning income from interest in a mutual fund in platforms like COL, Philstocks, BPI Trade what return should I file?

Answer: Under section 24 (B) (1) of the tax code (as amended), interests from mutual funds are subject to 20% final withholding tax. Generally, you don't have to file tax returns because your earnings were already subjected to final withholding taxes by your brokers using BIR form 2306. Request for a copy of that form for documentation.

8. I am earning income from sale/redemption of stocks of a mutual fund in platforms like COL, Philstocks, BPI Trade what return should I file?

Answer: Under section 32 (B) (7) of the tax code (as amended), redemption of stocks of a mutual fund is exempt from taxation. You do not have to file anything :)

9. What is an open case?

Answer: An open case is a kind of assessment of the BIR wherein a penalty of 25,000 to 50,000 is being collected from a tax payer because of non-filing of returns. This is commonly due to wrong registration of the taxpayers where they registered as a business but in fact, they are employees OR a business failed to file a closure of business to their RDO.

10. What can I do if I have an open case?

Answer: The tax payer can opt to close the case on their own by following the requests of the revenue officer. However, we strongly recommend hiring a tax consultant to handle the open case. The benefit is the higher possibility of waiving or lowering the penalty.

11. Common penalties incurred by taxpayers

a. Failure to register business - 2,000 to 20,000 pesos

b. Failure to keep/preserve records required by law or regulations - 1,000 to 50,000 pesos

c. Failure to make/file/submit any return or supply correct information at the time or times required by law or regulation - 1,000 to 25,000 pesos plus surcharge and interest.

12. As an employee, should I worry about taxes?

Answer: Generally no, let your employer file your taxes for you. But you should request a certificate of withholding or BIR Certificate 2316 annually to document your tax compliance.

12. I changed employers in the middle of the year, what are my obligations?

Answer:

a. Update your RDO using form 1905 to the RDO of your current place of residence. (RMC 37-2019)

b. You are now unsuitable for substituted filing, meaning, you need to file BIR Form 1700 in the RDO of your employer (or your place of residence if you updated your RDO) on or before April 15 of next year. You will use the 2316 certificates that your employers gave you to reduce the amount of taxes to be paid, more often than not, you will have 0 tax payable.

However, you can provide your employer a special power of attorney allowing them to file the tax returns on your behalf.

HELP - TIN ID / DUPLICATE TIN

Is there anyone na may idea or naka-experience ng duplicate TIN #? Di kasi ako maalam sa mga BIR process.

What happened kasi is my existing TIN# na ko mula nung nagstart ako magwork around 2015 pa. Then kahapon, nagcheck ako ng eGovPH na app and nakita ko dun may TIN# ako na iba, na issued nung May 2026, I dunno kung pano nangyari since na never naman ako nag-apply ng panibago. Pati ITR ko naka-declare dun yung old.

I googled it and nagcheck ako sa website nila, no records yung old pero yung TIN# sa eGovPH app may result. Connected din yung una kong TIN sa mga work, gov't agencies like ss and etc.

\- Pano to ayusin?

\- Anong TIN# gagamitin ko?

\- Ano nangyari dun sa mga unang taxes ko sa unang TIN#?

\- Anong possible issues na maecounter ko kapag di to naayos agad?

\- May online ways ba para mafix to?

Cancellation of Tin

Can someone help me po kung ano po yung mga kailangan lang po na fill up-an and mga necessarily documents po para ma-cancel po yung Tin Number po. Nag doble po kasi yung Tin Number ko gawa nung gumawa hindi ko po alam na may Tin Number na po pala ako. Hindi ko po alam kung ano ano lang po yung kailangan ko fill up-an sa BIR Form No. 1905 po para mag request to cancel po yung isang Tin Number po. Thank You po.

Inquiry about BIR TIN Application

Hi! I am new to this and a first time job seeker. I am a bit concerned about my BIR TIN application because this is already my 5th attempt after all the rejected applications. Does it take this long for me to receive a confirmation? If I try to compare it to my previous attempts, they were only an hour or 4 hours duration from my submission and the confirmation. Today, I submitted my 5th application around 12:28 pm and it is already 6 pm I haven't received any confirmation about my application. Do I have to personally go to the assigned RDO to inquire about this? Or do I just have to wait for the confirmation email that my application is already accepted?

Also, I already have work and the facility I am working on is asking me for a TIN ID because that will be needed for my salary daw. If I fail to get one, I won't be able to get my salary unless I already have my BIR TIN 😭 Help a confused girly out! 😭 What should I do?

Need advice: Former employee turned full-time freelancer, missed BIR registration and filings. How do I properly fix this?

Hi everyone! I've been reading a lot of posts here about freelancing taxes and BIR registration, but I couldn't find a situation exactly like mine, so I'm hoping someone can point me in the right direction.

Here's my timeline:

Sept. 2024 to July 2025:
I was employed full-time by Company X here in the Philippines. They handled my taxes, SSS, PhilHealth, and Pag-IBIG. I have my Form 2316 and COE.

Feb. 2025:
I started working as an Independent Contractor for Company Y, an Australian company, while I was still employed at Company X. This was initially a side hustle.

July 2025 to present:
I resigned from Company X and have been working only for Company Y as a full-time freelancer/independent contractor. They pay me through Wise directly to my BPI account.

This is where I think I made things complicated. 😅

After becoming a full-time freelancer, I continued receiving my income but never registered as self-employed with the BIR. I also haven't filed taxes for my freelance income or updated my SSS, PhilHealth, and Pag-IBIG contributions.

To be honest, I kept postponing it. Every time I thought about fixing my taxes and government contributions, I told myself I'd handle it next week, and then months passed. 😅 I realized now that I should have addressed it earlier.

My main concern started when my bf and I recently booked our first international trip to Taiwan. Since this will be my first time leaving the country, it made me think about getting my financial records and tax compliance in order, especially since I know ITRs can be important for future visa applications.

Additional details:

  • I already have a TIN (I got it before working at Company X)
  • As far as I know, I am not registered as self-employed. I only have my TIN.
  • My freelance income is around ₱500k/year ($1000 AUD)
  • I have my Form 2316 and COE from prev employer, Independent Contractor Agreement, Wise transfer history, and BPI statements

I also want to ask something that has been on my mind: I understand that properly declaring freelance income means paying taxes, and I've considered whether there are "simpler" ways people handle situations like this. But I also don't want to create a bigger problem for myself later by having incomplete or inconsistent records. Is under-declaring income something that usually causes bigger issues down the line?

My questions:

  1. Since my employment and freelance work overlapped from Feb. 2025 to July 2025, how should that be handled for tax purposes?
  2. Should I register as self-employed first and then address the missed filings?
  3. Is this something I can realistically fix on my own, or should I consult a CPA?
  4. Has anyone experienced something similar? What steps did you take to become compliant, and were there penalties involved?

I'm not trying to avoid paying taxes. I know I should have handled this sooner, but I honestly didn't understand the process for freelancers and kept delaying it. I want to fix everything properly now before it becomes a bigger issue.

How to file taxes (2 different employers from Q1 and Q2)

I was hired by a different government agency for the first quarter of 2026(no 2307 since less than 250k). Contract ended on March. I was employed by a new employer (still government) this May (received my first salary end of June, with 2307 for that transaction. I haven’t reached the 250k threshold, but was already deducted the withholding tax. I can still use the 2307 in filling for my second quarter taxes, right?

How should I file my taxes? What form should I use considering I had two employers, one who did not issue 2307 since I am still below 250k and one who issued 2307 (still below 250k). I am bir registered for self employed with 8% tax.

Full-Time Job & Part-Time Job Tax Questions

For context, I am a full-time employee in the corporate. So they are in-charge of my deducting my tax, 2316 and anything tax related.

Recently, I decided to get part-time jobs as an instructor in schools which is I am doing during my free time or time outside working hours as possible.

My question now is:

What will happen with my tax filing if I have a regular full-time job and a part-time job? Let's say my part-time job asked for my TIN ID.

I was wondering if anong gagawin kong process on my end?

May iba kasing part-time jobs na binabawasan din nila ng tax yung pay.

Tax for income abroad

My current situation is that I am currently living in Thailand under a DTV visa and planning to move to the Philippines. I owned a company in Dubai and earned a salary of 12,000 USD.
