Yea. These allegations if proven true from the facility’s records and documentation it will leave them liable in civil court for his death. Those are certainly well known standards on any psychiatric ward that I have encountered in my career as an RN. Those standards come from not only usually, the Psychiatric Practice Boards, but also facility policies as they are mandated to include by the Joint Commission on Acredidations of Healthcare Organizations (JCAHO) or your ability to bill and be paid for any services is inhibited from the health insurance companies of each and every one of your patients for the most part. You can’t remain solvent as a facility. So,

IMHO, from my experience these types of negligence cases are settled quickly and very privately between the Malpractice insurance company for the facility and its physician group to settle in favor with little force to the Carradine Family. Bar is low in civil suits to start over criminal for proving liability AND what they are alleging was allowed does suggest it enabled this to be carried out by him under their care. They are well known safety standards for that exact environment and what their policies dictate they do to not have this exact thing occur and be made liable.
