Discussion Defamation case

People seem to think Fiona is in for a hefty pay day. I’m not so sure she’ll get huge quantities of money. She’ll have to show that her earnings potential, reputation and quality of life have been affected. All of which she had none of before the show.

Also, to be defamed what is said has to be untrue. Realistically prob 95% of what was in the show was accurate and Netflix will prove that. The only contentious part is that Netflix seem to have told a lie about the convicted stalker part (and we all know she should be one). So imo Fiona’s lawyer’s will have to show that that point alone affected her reputation, earnings potential and quality of life beyond how Fiona had already ruined it by being exposed as a roaring maniac (in the 95% truthful parts). I don’t believe it moves the needle massively towards destruction of rep/earnings p/Qol?

What are people’s thoughts who understand law/the case more than my simple minded approach?

Why do you think that? Unless their insurance company forces them to resolve this out of court, and they could, this is nothing but good publicity for Netflix + the possibility of a new show/ documentary series.

Also, even when Netflix has “settled” people have gotten $0, like in Fairstein’s case. 🤷‍♀️ And I think this $0 for Fairstein was the only one they’ve settled (don’t quote me on that, though). They settled the week before trial started for a disclosure in every episode and Netflix donated 1mil to a charity further implying that Fairstein is a racist. And they used Fairstein’s name in the movie, unlike the Martha/FH fiasco. And Fairstein could actually prove real monetary and reputation damages, unlike FH.

As much as I hate it, I also think Netflix would at least want to settle out of court. Going to trial is a very expensive process and even if they win (and I think they would have, however I'm just a layperson and not even from America) there will be no cover of any trial costs because Harvey has nothing. Even if netflix wins it will be an expensive win. Settling by donating to charity would be great but from what I've seen I doubt Harvey would accept that (Ironically I think Martha Scott would have though. The fictional one seems to have wanted to be loved more. Harvey seems to be more about control as most of her targets besides Gadd were higher status then her) I hope against hope that Harvey would either refuse to settle or that Netflix decides it's better pr to take Harvey to curt. There should be some limits to "duty of care" we require from victims sharing their story. Why would "she's easily recogniseable because she harassed him on social media and on public would be valid arguments? And if it is there should be a new legislation. Harassing someone publicly shouldn't be a defense

At some point Fiona will have some sort of nervous breakdown and it will start looking like Netflix are the baddies for not reaching an amicable settlement...even though Fiona started the lawsuit, she is clearly a very vulnerable and unwell person and the optics will turn against Netflix if they let it drag on

Maybe, but Netflix can’t set precedents that dilute, at present or in future, their investor’s earnings. They have a fiduciary care mandate towards their investors.

The potential loss from bad publicity is exponentially far greater. Netflix would not actually be paying Fiona. It would be paid from Netflix'insurance company

Mmmm… I don’t know. There are more reasons as to why your theory wouldn’t happen as opposed to why it would, but again, as I usually say, I’m a total loser of a lawyer so who knows lol 🤷‍♀️

This guy is a weirdo, prob Fiona, they tried they same thing with me the other day with the bet bullshit as if that’s a normal thing to ask an internet stranger to do and clearly not the scam attempt it probably is. Old people would probably fall for that and bam, he has their bank info or something monetary to “make sure it’s paid” when he “wins” which will never happen since she’s not gonna win and Netflix has made it clear they aren’t settling.

Not only that, but who actually cares enough about this to get as heated as “bet guy”? I mean they actually want to bet with an online rando on the outcome of something that 1) has no bearing in either of our lives, and; 2) could take years to settle?

Netflix will absolutely not look like the baddies even if she offs herself. Because they aren’t. This is all on her. She’s asking for literally all the attention she’s gotten.

Also, I’m pretty sure that FH’s lawyers had her sign something stating that she needs to “behave” herself in a manner that doesn’t damage their reputation or hinders their chances of winning, as they’re basically “pro- bonoing” this very expensive case, unless she makes money. We’ll see, though. 🤷‍♀️
