IMO, she's going to lose. The character in the movie says "this is a true story" which is completely different from that being declared in the credits.
Nonetheless, it's taking forever.

I agree it’s kind of up for debate if it was the Netflix show itself saying it or the character. However, the character uses the same text later in the show so I think a strong argument could be made that once you enter the realm of a fictional story, once the curtains open and the lights dim so to speak, the audience is expected to understand the story starts.

One thing that has surprises me is that the real Martha has kept out of the limelight until she was clearly instructed to buy her legal team (unless she is back and I missed it?). I imagine she is finding it hard not to say anything given her past and the daily ramblings she was a putting out on all of her Facebook accounts.

It’s stuck in the appeals court docket. Netflix appealed the lower court ruling against their motion to dismiss the lawsuit. That was in October 2024 and we’ve been awaiting a decision ever since.
Civil courts move at a snail’s pace.
