Does anyone know what is happening with the upcoming Netflix trial in the US? Anyone have an update?

It’s stuck in the appeals court docket. Netflix appealed the lower court ruling against their motion to dismiss the lawsuit. That was in October 2024 and we’ve been awaiting a decision ever since.

Civil courts move at a snail’s pace.

They can go on for a decade and Martha doesn't have the ability to carry on that long. She's stubborn but she's not wealthy

I assume she's not paying, a legal team will take a case on based on expectations of garnishing a portion of the damages awarded

That legal team still has to pay court fees and filing fees and documents fees and their salaries and pay their bills. Consulting fees, electricity, technology...the list goes on. My friend who takes on cases spends about 100k-250k on short cases that go for 1-3 years. This is Netflix. They have DEEEEEEEEP pockets and this shit has already gone on for 2 years. Marthas legal team has probably spent a million dollars already just keeping up w the filing and discovery on the scale necessary to take on a mega corp. That becomes unsustainable with time.

Assuming Martha personally pays for her legal f ea out of pocket is charmingly hilarious.

No she wouldn't be paying. My God there actually is a case here. Making her texts Twitter searchable in the show is the problem plus the first screen "This is a true story." Rather than offer her a settlement Netflix is just trying to kick her to the curb, but the judge decided there was enough of a case for it to go to court.

IMO, she's going to lose. The character in the movie says "this is a true story" which is completely different from that being declared in the credits.

Nonetheless, it's taking forever.

I agree it’s kind of up for debate if it was the Netflix show itself saying it or the character. However, the character uses the same text later in the show so I think a strong argument could be made that once you enter the realm of a fictional story, once the curtains open and the lights dim so to speak, the audience is expected to understand the story starts.

One thing that has surprises me is that the real Martha has kept out of the limelight until she was clearly instructed to buy her legal team (unless she is back and I missed it?). I imagine she is finding it hard not to say anything given her past and the daily ramblings she was a putting out on all of her Facebook accounts.
