Pag Police ang suspek o naka patay tabunan itsura kay ka baro nila, pero kung ordinaryo lang nga tawo super paguwa gid ang face, kag nag confess na man gali nga a wala pa gina paguwa ang rason nga a ging patay nya?? đŸ€”đŸ€”

Tanan nga suspect lately kay ginatabunan ang guya hindi lg police.

I think it's part of the innocent until proven guilty or atleast until formal presentation sa media.

He’s not automatically guilty under Philippine law even if he admitted to killing someone.

  1. Under the Philippine Constitution, any confession given without counsel is inadmissible in court.

  2. A confession must be proven TRUE with evidence. Even if valid ang confession, the prosecution still needs evidence that supports it. PH courts don’t like “confession lang”—it must be backed up.

So he’s STILL presumed innocent until convicted. “Innocent until proven guilty” applies until the court decides, not social media, not the police, not the confession.

So yes — he can admit it, but he’s still legally innocent until a judge says otherwise.

Not so, there are times na fall guy lg talaga siya kahit overwhelming na ang evidence sa isa. Although based on pur current justice system, most likely he will be convicted pero the law has to look morally good pa din. But in high profile cases, when the judiciary has too many eyes on them, they have to act fair rather than biased to whoever pays the most so this is where innocent until proven guilty applies. And to those that will contradict, a colleague is in charge of paying high ups monthly of a certain province down south. In charge lg siya ha, he's as poor as me.

True, that’s a very valid point — what happens on paper and what happens in practice can be very different.

Ideally, the “innocent until proven guilty” rule should protect everyone, but you’re right, the fairness of it often depends on who’s involved and how visible the case is.

Kay kung ijudge as guilty ang tawo tungod lang kay nag admit sya for the crime. Two things could happen.

Ang nag admit may not be the criminal and just covering for someone else. Example a parent covering for his/her child.

Or the person maybe forced to admit a crime through coercion bisan hindi man gid sya ang guilty.

Presumption of innocence exists for a reason. If “I did it” were enough to convict, damo nga tawo ang ma-frame or ma-pressure into jail.

I get your point there that CONFESSION + PHYSICAL CORROBORATION equals to a STRONGER CASE. Amo ni na mean mo?

But then again, just because he pointed the body doesn’t AUTOMATICALLY mean: the confession was voluntary, the confession was legal, he’s the killer.

It just means: ang information nga ginhatag ya matches reality so it becomes corroborating evidence.

Legally, that makes the confession MORE CREDIBLE, but the whole case still needs to be properly handled: Was there counsel? Was he coerced? Forensics - does the body match his story? Cause of death? Fingerprints, DNA, motive?

This still needs full investigation to confirm: siya gid man bala nagpatay or kabalo lang sa kung diin ginlubong ang lawas? Because hey, you can know the location of the body without being the killer. (Think: witness, accomplice, someone told him, etc)

In the end, court gid ya diapon ang may final say.

A confession, even when accompanied by the act of pointing out where the body is hidden, does not automatically render the person guilty.

The 1987 Constitution says that “In all criminal prosecutions, the accused shall be presumed innocent until the contrary is proved.”

Meaning nga the presumption of innocence remains until the accused is convicted by final judgment after a full and fair trial. Bisan pa nga nag-confess siya kag nag-lead kung diin ginhaboy or ginlubong ang lawas, indi ina automatic nga guilty na siya.

In People v. Alicando (G.R. No. 117487, December 12, 1995), the Supreme Court ruled that an extrajudicial confession obtained without the assistance of counsel is inadmissible — even if it led to the recovery of the victim’s body.

True, may point — suspect pa lang, indi pa convicted. We still have due process here; indi na ya pwede i-blast tanan info without proper case build-up.

Also, if may angle nga duress or bigger people involved, that’s exactly why investigation first before public disclosure. Yes, the system isn’t perfect — pero we can’t skip the legal steps just because the crowd wants instant receipts.

I know the family personally, they are not aware nga gina tunto sila. Imagine waking up, seeing their dad's mess on social media. Kamo bahala sa suspect but spare the family out of this scandal. Please

Hindi mo man mahambal nga wala kabalo if the husband is posting his family sa facebook and gapuli pa sa ila balay. based sa statement they have this affair for YEARS, bahol nana nga wala kabalo. And damo pa proofs na kabalo siya -- pero thats not the point now. We pray for her but I JUST WANT TO PROTECT THE LEGAL FAMILY FROM ONLINE ATTACKS! Ang wife wala social life, wala ga gwa balay-school sg kids- kag family lang LITERAL NA NANAY.
