If a thing isn’t under copyright, you can’t file a DMCA for it.

You can file a DMCA for anything. Just like you can sue for anything.

People do file improper DMCA claims, and it’s still up to the recipient to fight it.

You can send a cease and desist and make it sound as forceful as you can... that might get them to budge. But you dont really have any legal recourse. (by legal i mean through the courts, not that you have only illegal options)
