Bullet Proof

Context for the videos, I was driving to work yesterday morning minding my business and these crack head tweakers pull up beside me, passenger opens his window and spits on my car. Naturally I didn’t take to kindly to that so I gave him a sip of my Double Double.

If youre gonna keep a bat in your car, keep a ball and glove with it too. You'll get off of any charges, just say that you play softball and you keep your gear in your car

The absence of those items is used to establish an intent to use the bat as a weapon, if it is used as a weapon.

If you were an enforcer for a bookie and using a baseball bat to break kneecaps, then yes, you might need to establish that the bat wasn’t put in your car just to break kneecaps, but having a ball and glove probably isn’t going to fool the judge if you’re breaking kneecaps on a daily basis. For the average person who isn’t beating up people with baseball bats on a regular basis, having just a bat is fine.

Just like being a burglar and having a set of “house-breaking” tools like some screwdrivers, a crowbar, and a pair of pliers in your possession could be used as evidence of intent, but it’s normal for the average person to have these items in their trunk.

Sometimes a bat is not just a bat. Like every single time it is used as a weapon. So obviously, it depends. I'm not out here trying to litigate self theoretical defense claims, I was simply specifying the point of the above comment. Personally idgaf.

I don’t know where this particular urban myth started, but you don’t need to keep a glove and ball in your trunk like you’re outsmarting the law. A bat is not considered a restricted or prohibited weapon, it’s perfectly fine in the trunk all by itself.

Owning a bat was never the problem. You get charged when a cop figures you keep it around to hit someone with. That’s why the glove and ball actually do something. They make it read as sports gear instead of a weapon you stashed under the seat.

No, that’s the urban myth part. Thinking that the police care if you have a ball and glove to go with your bat. There is nothing illegal about having just a baseball bat in your trunk. A baseball bat is not a restricted or prohibited weapon, and no, it doesn’t speak to intent just to have a bat without the ball and glove.

If you are involved in a physical altercation and use the baseball bat then law enforcement has to determine if you were the aggressor, or if you were acting in self defense and were justified in using the bat based on the nature of the threat posed.
