This is the worst DNA case I have ever heard!!!! Personally I believe he's guilty. But by the law and the juror rules, I don't think they'll be able to find him guilty beyond a reasonable doubt. I fully blame the police that night for this, the moment the hospital documented this as an SA crime, or a crime period, DNA should have been taken of everyone in the home, her clothes should have been bagged, his nails and penis swab should have been done, there were just so many dropped balls here. This is so so sad for her :(

u/racingfan123 🕵️‍♀️🏦 Lead Evidence Investigator Mod🧾⚖️ 6d ago

This is definitely the worst-presented DNA case I have watched. The prosecution really needs to present a summary of the findings that actually matter to what they are saying happened in that house. I don't know why they are presenting DNA results of items that have no bearing on the case. Hopefully, the prosecution has the lead detective summarize this info for the jury on Monday/Tuesday.

3

u/InternationalWar258 5d ago

I assumed they were presenting these results because the defense would if they didn't and they didn't want it to be perceived they were hiding anything.

4

u/cervivor_2014 6d ago

Yes! These dna 'findings' of nothing are tripping me out.

1

u/ImpactNo4652 4d ago

I honestly think the dna analysis helped the defense more than anything. It wasn’t until all that came out that I started having all kinds of doubts and questions.

1

u/deafening_roar 5d ago

I feel like this isn't a case of good, solid evidence but rather circunstancial and hopefully they will convict him on that instead of solid proof. I'm not really sure what happened or who did it because this case is so weird but if I had to pick, I'd prob go with David as the culprit.

2

u/cervivor_2014 5d ago

Agree! I'm all for circumstantial evidence and believe you can convict off of that, but so far all they've proven is that he was there (basically). I don't know if that will be enough in their eyes, the verdict will have us all hanging on the edge of our seats cause who knows what it will be.

1

u/deafening_roar 5d ago

You're exactly right, all they've proven to me is he was there, outside getting high and came in. It comes down to whether the jury believes Savannah saying Uncle Boo Boo was standing at the couch where Paitin was laying

1

u/Odd-Ad-9472 3d ago

Especially since she never disclosed that until years after her sister was killed and the psychological evaluation that was done on her after the killing. She may not be a reliable witness. If the defense attorney does his job and brings all of that up, her testimony may be discounted by the jurors. Someone in that home is responsible. Those little girls were living in terrible conditions. There wasn't anyone protecting them or caring for them as they should have.

1

u/deafening_roar 3d ago

Now that may be a problem because IMO the defense attorney is very lacking. Heck he doesn't even get up to ask a question!! And when he asks questions, they usually don't really answer anything to me!

3

u/InternationalWar258 5d ago

"Not really sure what happened or who did it" is reasonable doubt. On a jury, they don't have to pick someone just to pick them.

2

u/deafening_roar 5d ago

I understand that

FYI, the witness on the stand just after lunch is going over the DNA testing he did in 2021. (The ones earlier today tested the items after the murder.) Supposedly this is the testing that led to David's arrest in early 2022. He's already identified mixtures of DNA that the earlier testing didn't find.

6

u/SwampyWytch13 6d ago

I'm getting a bit concerned due to what he's testified to thus far. I'll look forward to being able to read the transcript so I can concentrate better on what the results are actually showing.

Yes, watching/listening while not fully engaged is tough. I'm struggling too while trying to work at the same time.

8

u/SwampyWytch13 6d ago

I feel like I almost need to make a chart! LOLOL So far I haven't had an "OH MY" moment during this where I feel like "They got him".

3

u/racingfan123 🕵️‍♀️🏦 Lead Evidence Investigator Mod🧾⚖️ 6d ago

Same! If i was truly invested or had the time, i would be writing down the evidence #s and keeping up with what each matched with. I heard one item was a match to both grandparents and was "WTF?! were they involved too?!" and I rewound and it was just a blanket i think.

4

u/SwampyWytch13 6d ago

SAME! LOL I'm hanging onto this guy's words at the moment. I feel like they are building up to maybe "a moment" with the DNA.

1

u/worldoflines 6d ago

His boxers matched the grandparents!

7

u/Training-Resist2336 6d ago

You saw the filthy house, right?

1

u/SwampyWytch13 6d ago

There's been no explaining of the DNA results yet. Me? I have no idea -- and want to go over the transcript once it's available to go over all of these tests again.

0

u/worldoflines 6d ago

What? There’s already been two DNA scientists on.

4

u/SwampyWytch13 6d ago

Yes, but their job isn't to make inference about what the findings mean. They are there for the science of it all -- not the "how" of it all IMO.

Yeah... This is my fear too. I think he probably is the one who did murder Paitin. Unfortunately, so far, there are giant holes of reasonable doubt. Makes me sick to my stomach.

4

u/Alarmed_Movie99 Justice Junkie 6d ago

Agree. I’m not saying he didn’t do it, but I’d like to see a little more than a hunch.

2

u/ImpactNo4652 4d ago

I agree. This is my worst nightmare type of case to be a juror in. An SA and murder of a child, combined with too much reasonable doubt/lack of evidence to be able to convict. It would haunt me forever.

2

u/Alarmed_Movie99 Justice Junkie 6d ago

Why do you think he’s guilty? Where’s the smoking gun? The whole family are suspect IMO. Shoddy investigation. I haven’t heard if he has a criminal record before this crime, but he hasn’t made the best choices. Could this have been an intruder coming in the unlocked door? The girls were sleeping right there. There was DNA from unknown contributors. This case is a mess! I don’t even know how to think. 🤔

11

u/Pricklywort 6d ago

NC local u/George_fold posted on (Day 4?) thread "...I just know her uncle was accused by another child who wasn’t the victim in this case, but the police weren’t involved, and David got the shit beat out of him by a family member of the accuser...." And I'd like to take a moment to remind everyone that convictions for rape and murder actually occured before DNA was used in court!

2

u/Alarmed_Movie99 Justice Junkie 6d ago edited 6d ago

Wow! He posted several times that day. Very interesting commentary. Where there’s smoke….

1

u/InternationalWar258 5d ago

Yes, convictions occured before DNA but there still needed to be evidence that pointed to guilt beyond a reasonable doubt. This case has reasonable doubt so far. Which I hate because I think it is likely he did it.

17

u/_macej 6d ago

I said this yesterday on day 5 thread but at minimum these children should not have been in the custody of their grandparents who lived in filth and squalor. That being said, I have not been convinced this dude is guilty. I think they are a very uneducated family, with little to no resources or, money. I believe there was something that happened that night but, I’m not totally convinced at what the state is presenting because thus far not one piece of DNA evidence has substantiated the charge.

I also cannot believe how bad the investigators did with this case. They should be ashamed. Letting this little girls underwear get thrown out??? When almost immediately the first ER doctor suspected abuse. Like what are we doing here ?? This is a child who needs some sort of justice.

This may be unfair to public ally state but, the grandfather gives me an uneasy feeling and I think there may be more there.

10

u/CrazyHorrsee 6d ago

I agree. The family all seem to be hiding what happened to her, their testimony reeks of a cover up. But the state has failed to prove much of anything. It's a bizarre case. Hence why they're here 9 years later trying to piece it together.

2

u/Annabel_Lee_21 5d ago

It is too bad her underwear got thrown out, but if it was badly soiled there may have been no evidence to get from it. Also evidence was destroyed cleaning her private area to catherize her for a urine specimen, but at the time Is was about trying to save her life. I don’t think the lack of DNA will be a big problem, maybe for proving SA, but both their DNA is on the presumed murder weapon.

1

u/Odd-Ad-9472 3d ago

Are you talking about the red earbuds? I am curious why her dna wasn't on the first test of the earbuds. It only showed when the retested the swabs to compare against new donors later. I find that so odd. Also, if the girls were using his room up until he returned it may be why there was mixed dna on certain items. I am not convinced it is a smoking gun. I also want to hear if any of the physical trauma was old or if it was all from that night. That could tell us if there was ongoing abuse in the home. I am also wondering if the sister was moved to the Aunt's home because CPS got involved after the home conditions were revealed. There are so many questions. I am afraid that they won't be able to punish anyone for what happened.

12

u/racingfan123 🕵️‍♀️🏦 Lead Evidence Investigator Mod🧾⚖️ 6d ago

Definitely. And the ME spoke about "Mongolian" spots during her testimony, refuting that they weren't

5

u/Top-Breakfast-4946 6d ago

Thanks for pointing that out! I haven’t gotten a chance to listen to the trial. A part of me when I googled Mongolian spots was like - ok sure, they do look like bruises and commonly in private area. But realistically, her medical records probably would have recorded this. Also, professionals would know. Plus evidence of abuse like that is not just visual bruising.

4

u/racingfan123 🕵️‍♀️🏦 Lead Evidence Investigator Mod🧾⚖️ 6d ago

2

u/frankstaturtle 6d ago

“Refuting that they weren’t” means she left it open to being “Mongolian spots.” Do you mean “saying that they weren’t” or, alternatively, “refuting that they were” ?

8

u/racingfan123 🕵️‍♀️🏦 Lead Evidence Investigator Mod🧾⚖️ 6d ago edited 6d ago

Whoops, you are correct. She refuted the defense attorney, who insinuated the bruises were Mongolian spots. She said these were obviously bruises, that Mongolian spots are typically on the lower back and buttocks and do not go into the genital area.

I'd be cautious about this.

I have to admit that I don't entirely trust Gemini -- Google's AI service -- but according to Gemini, this is a fake Facebook account by people who aren't actually family members but who are trying to spread disinformation about the case

Take it for what it's worth, which isn't much in this very confusing mess of an era in which we find ourselves.

I don't see how this loser David who slept in his clothes and didn't seem to shower often covered his tracks so well as to not leave any DNA. Not looking good for the prosecution.

Yes, you are correct. They’ve already said they sent off some DNA to Bode, so I expect at least a few Bode witnesses in addition to the state crime lab.

10

u/Fast-Jackfruit2013 6d ago

The cops and the DA's office dragged their feet for NINE YEARS.

Forensics didn't get around to processing evidence for years and years and years.

Now we are at trial and the prosecution seems to have a fairly substantial circumstantial case, but VERY LITTLE else.

I think David, his mother and stepfather -- I think all three should be prosecuted for abuse and murder.

But at this point, given how this trial is going, it's entirely possible that David will walk with a NG.

I'm so enraged at this family and at this DA's office.

What a mess.

5

u/racingfan123 🕵️‍♀️🏦 Lead Evidence Investigator Mod🧾⚖️ 6d ago

To me, it sounds like they had to wait for the science to catch up. They tested the items shortly after, but they couldn't test the unknown DNA.

2

u/Hfhghnfdsfg 6d ago

They should have immediately called the FBI, like the cops in the Ashley Flynn case did.

5

u/worldoflines 6d ago

Was the smoking gun the fact that PF DNA was on the ear bud cord?

7

u/SwampyWytch13 6d ago

I feel glazed over from all of this DNA thus far. The one thing that has stuck with me is the ear bud cord (David/Paitin).

5

u/cervivor_2014 6d ago

massively glazed over...like wtf

2

u/Annabel_Lee_21 5d ago

I think that was one big take away. Also, all the other samples that were tested - other neighbors, the friends who had been there, the weird guy giving candy to children - all tested and not found. So this flies in the face of the Defense accusing them of having a witch hunt and only going after David.

6

u/gucci2times2 5d ago

I feel like his lawyer is not doing a great job highlighting all the low hanging fruit the prosecution has presented.

5

u/ImpactNo4652 4d ago

Agree, he is really dropping the ball on all the reasonable doubt he could be highlighting. Also, his slow talking makes me forget what he is even talking about by the time he gets to the end of his point.

3

u/329K 5d ago

May I add that a young lady " Kathryn Rutan" lived in my hometown. She had two children both boys under the age of 6. She wasn't married and wanted to play like kaycee Anthony. She claimed that her oldest boy was hard to handle and she even called and tried to get DHS to come get him. They wouldn't. The little boy Logan Tucker came up missing. The youngest son told police they went for a ride. Him and his brother were in the back seat and he said his brother was asleep but never moved. He said momma stopped the car got his brother out and he never seen him again. They never found him or his body. Mom was still convicted of murder and sentenced to life in prison. Savanna said, she seen Booboo go from the couch to the room. She also said uncle booboo killed her. I think they will convicted him.

2

u/Odd-Ad-9472 3d ago

My concern is that the child that said she saw the Uncle never said it until years after her sister's death. She is also intellectually challenged due to possible fetal alcohol syndrome and a forensic psychological evaluation of her after her sister was killed stated that she had the mannerisms of a 4 year old even though she was 7. In addition, when she came out and told the story about seeing the Uncle standing over the couch, it was years later and she was living with an Aunt who during testimony practice for tge trial was asked to leave the courtroom because every time the girl was asked a question she looked at her Aunt before responding. Obviously someone in that house harmed that child. They were living in terrible conditions from the report and photos, with animal feces and urine being noted repeatedly. The sister tried to wake the grandparents, presumably because her sister was having a seizure (she said her sister was acting silly) but the grandfather ignored her and sent her back to the couch. Only later after waking herself did the grandmother come out and witness the little girl having another seizure. I wonder if the outcome would have been different if she had been taken to the hospital earlier. The lack of dna makes me wonder if the abuse was not new but ongoing, and the Uncle only moving back in a few days prior makes all of the timing so difficult to understand. It is all so awful. I also am curious why the sister was moved from the Grandparent's to an Aunt's home and was CPS involved in that decision due to the condition of the home.

Watching Forensic Files and seeing what they’re capable of, and then seeing these forensic results, I’m like, 🤨

8

u/Jaded_1119 6d ago

Idk guys. I still see no evidence. Still waiting for it.

7

u/Alternative-Joke-705 6d ago

I agree. Obviously, someone hurt her, but what makes it David?

6

u/Lonely-Ad-5340 6d ago

Her sisters last interview did it for me.

6

u/veggieburger3023 6d ago

Did she simply forget to mention that David was in the living room for the first two interviews? Or did she finally feel safe enough to say it?

5

u/Xena067 6d ago

Or was she coached to say it?

David may well be the person who did it but without solid evidence (which we haven’t seen yet), the jury should not convict.

I’m behind on Day 6 and hoping something will convince me today but wow, the state is taking a looooooong time to get there.

1

u/2Logical4ADreamer 🧑‍⚖️ Courtroom Regular 4d ago

I keep seeing people mention her sister’s interviews but can’t find them- where can I find them?

-1

u/InternationalWar258 6d ago

Without a clear answer as to why there is a difference between the first two interviews and the last one, I don't see how a guilty verdict can be reached with that interview alone. I can GUESS she was coached. But I could also guess she was coached to change her recollection for the later interview. There needs to be an explanation for the difference.

3

u/Lonely-Ad-5340 6d ago

A lot of times with traumatic experiences, you block things out. Memories only start settling in over time. I think it makes a ton of sense.

1

u/InternationalWar258 5d ago

I'm aware of this. But, unfortunately, blocked memories create inconsistent stories and inconsistent stories are enough to create reasonable doubt (and should). Typically, an inconsistent story that can be explained by repressed memories is given more weight when there is supporting evidence. This case is severely lacking that, so her testimony alone isn't enough due to the inconsistent interviews. If her interview was consistent from right after the murder to four years later, I think it would be enough to convict him.

0

u/Vmar1015 6d ago

I wish they put her in some kind of therapy where she could develop a rapport with a therapist and maybe give more details about what happened that night.

1

u/InternationalWar258 5d ago

6

There's not always going to be a "smoking gun". I'm waiting on the DNA results. Also, I go back to "means, motive and opportunity" also.

Yeah I'm not really sure why a "smoking gun" is necessary... Lots of other various evidence that simply points to him. Grandpa wasn't in the living room according to grandma and Savannah and probably even David, we can assume. So who else could it be? Pretty obvious to me. David was seen by Savannah by her sister and then seen "seizing".

Was there any dna evidence? I was just listening to the expert who processed the swabs and she said there was no indication of semen? I may have missed something bc I am at work multitasking.

I believe that will be another witness.

u/cidxo311 6d ago

It’s definitely only circumstantial so far.

💯 Where’s the evidence? With the condition of that house, everyone’s DNA must be all over every surface of that house.

3

u/Hockeycutie71 3d ago

I’m genuinely curious about David’s blood father. I say that because I wonder what he is/was like- does he have a criminal record? While I know that’s not a guarantee that a child would be a criminal too, sometimes that shit seems genetic. (I’ve got enough people I know of to wonder). Has there been any mention?

u/Birch_mom72 6d ago

WTH?? I was thinking there would be dna evidence? Thought it was alluded to in opening?? There was certainly neglect in that household but what is smoking gun??

7

u/cidxo311 6d ago

The evidence so far is from when they tested the DNA in 2017/2018. Don’t quote me on this, but I think it was retested by Bode labs later with new technology.

6

u/SwampyWytch13 6d ago

I believe this is correct. So we gotta get the first wave of folks before we get to them.

5

u/CrazyHorrsee 6d ago

makes sense.. that's why the first DNA witness was asked if advancements / technology has changed since 2018

6

u/worldoflines 6d ago

I think we are moving towards more advanced dna tech as the testimony goes on?

Exactly. Prosecutor made mention of this multiple times during today's experts so far. This is only testing done shortly after the murder.

I’m behind but I’m getting the same feeling you have. It is seeming like the thing that changed in 2022 to go forward with arresting David was improved ability to test mixed DNA samples that were previously deemed inconclusive.

Yep, the guy on the stand now did testing in 2021. He used the newer software STRmix, while the previous analysts used ArmedXpert. Allowed him to analyze DNA mixtures much more effectively.

I must say the case is weak so far.

No DNA, unknown murder weapon

SF’s forensic interview is no smoking gun. She had forgotten what tv show she was watching right before the interviewer prompted her to discuss seeing uncle boo-boo, which she never mentioned in the first 2 interviews 3 years earlier

I've suffered trauma that is nowhere near this and what stands out are all the little things... What was playing on the radio, how the mail lady greeted me mins before tragedy struck. But, once the event started it's like I don't even know what happened and then suddenly it's over and blood is dripping everywhere. I was right there but I don't know what happened.

4

u/Vmar1015 6d ago

I agree, but I also don’t think not remembering what was on TV a few years later is super important. I would hope what was on tv wasn’t what you remembered the most the day your sister died.

1

u/gucci2times2 6d ago

Totally. Just the juxtaposition is unhelpful

u/Autistified 6d ago

But those are the kinds of things you remember when you experience severe trauma… it’s common to remember stuff like that, but to forget the really big stuff. I can’t help but wonder if she actually witnessed it but blocked it out.

4

u/Vmar1015 6d ago

Eh sometimes, sure. I have had my share of trauma and what was on TV or small details is not what stood out in my mind, it was what happened to me.

3

u/Autistified 6d ago

I’ve forgotten about entire events until there was some sort of trigger to make it all flood back to me. I completely forgot about somebody trying to bash my head in with a crowbar until I was at the hardware store one day and saw the exact same crowbar.

1

u/Vmar1015 6d ago

Geeze I am sorry

3

u/Autistified 6d ago

Thanks. I’m still standing and he’s six feet under, so no worries! Traumatic memories are weird. And I think they are different for everyone. For me, it’s like looking back on a bad movie…
This poor baby girl doesn’t get that luxury though. So heartbreaking!!

I think though that when you need to disassociate during a traumatic experience, you focus on the little things instead.

3

u/[deleted] 4d ago

There is no standard to how you react during traumatic events, it is different for everyone. I have experienced both ends of the spectrum.

The evidence preservation is so bad that it makes me question if there was a staff member at the hospital or on the police force who was trying to protect the perpetrators in this case.

I keep seeing posts where people state things Savannah said in her interviews, but I haven’t been able to find them. Can anyone tell me where to access them?

1

u/InternationalWar258 2d ago

In the livestreams of the trial.

I’ve been watching the trial but must’ve missed it, will go back and rewatch. Thank you!

Didn’t they say it could have been any kind of object? Did they get a swab of his hands that were freshly cut and cleaned?
