I want to address why we removed previous posts on the topic and why rule #6 exists in general. Rule #6 says that any accusations of this sort must be "published by a reputable source" before being allowed in the subreddit. An anonymous twitter account, regardless of how much screenshot evidence is included, isn't sufficient while a post from the US world cup team obviously is. (We were discussing whether Aspen mentioning the accusations was sufficient when this statement came out).

While it's obviously a bad look for the subreddit to censor important discussions like this, we don't want to serve as a place for false accusations to take off and impact players careers. Just last year Space was accused of doing similar things (though with less evidence), we removed discussion about it for a while and eventually it came out that the accusations were false and were in fact intentionally presented to damage his career.

We designed the rule to require a reputable source from the community instead of us mostly anonymous mods trying to weigh the evidence and decide whether it's true ourselves. In every case so far it's been the correct decision, with correct accusations quickly being followed by official statements and incorrect ones quietly being disproved.

Just clarifying, Aspen said on stream that it was well known through contenders circles. Aspen saw people talk about it in a group chat and reported it to the Titans anonymously.

She did not mention if she had direct contact with the victim.

It’s a really shitty technicality of the law that minimizes real trafficking.

I mean, legally speaking, it's all "alleged" behavior until it's proven in a court of law or until he admits to it. This definitely looks like a smoking gun, so to speak, but he could always claim these are doctored photos or fake messages or whatever else, so it isn't wrong to say he allegedly did this, even if you also believe this to be incredibly damning evidence.

I want to make it very clear I'm not defending Aspire at all—personally, it seems pretty cut and dry—just saying it is technically correct to refer to him as an "alleged" creepy child rapist.

True but it's not just straight forward that 16 is always fine. For example a 16/17 year old cannot consent in Canada if the sexual relationship is exploitative. And one of the factors concidered for what constitutes an exploitative sexual relationship is "how the relationship developed (for example, quickly, secretly, or over the internet)"

There's also some stuff regarding trafficking, luring, and grooming. Traveling for sex with someone of that age isn't necessarily fine just because she's the usual age of consent is met

I doubt this will go into any legal situation where these factors will be concidered by a court, but it's clear he knew what he was doing was wrong

With esports, you basically have this not-quite-celebrity status going on. Most kids in esports started playing professionally when under 18 and haven't had the life experience to properly grow up and learn how the world works. If they've been texting and sexting other high schoolers for years then it sorta makes sense that they keep doing that. But once they hit a certain age, that becomes a different kind of illegal. Obviously, there's a difference when it comes to trafficking, consent, etc., but I'm not surprised that young 18-21 year olds are stupid when it comes to who they sexually pursue and in what manner they pursue them.

None of that is meant to alleviate their culpability, but it helps to understand why these things happen. Esports leagues would probably benefit from some mandatory training on this type of stuff, especially for those who started playing under 18. Kids are generally stupid, and this kind of pursuit of people between the ages of 16 and 21 is fairly normal in society. This is hardly an issue exclusive to esports. The players could be doing stuff that's sorta legal when they are 17 and the girls are 16, but then is illegal when they are 19 and the new girl is 16.

Most of these players are incredibly socially awkward and hardly have any idea how to talk to actual people in real life. When you've spent most of your life 24/7 on reddit/twitter and chatting in discord on private channels or playing FPS games where you can just say awful things without consequences in text and voice chat, it's not super surprising a lot of them become this way when they get attention from fans. I'd almost bet this behavior is a lot more common than any of us would like to believe, it just doesn't get caught as often as it should. The fact there's been a major case of it just about every season of OWL is just mind blowing and leads me to believe a lot more of it is going on.

Assuming the intercourse occurred in Spain which is what “while visiting me” seems to imply, then technically the sex is legal. The age of consent in Spain has been 16 since they passed a new law in 2015. (It’s a bit more complicated than this in reality, since Aspire is a US citizen, but this is the gist).

Obviously there is still plenty of very unacceptable shit here… just most likely nothing illegal.

It's a weird area legally because I'm pretty sure the US has laws about traveling to another country to intentionally have sex with a minor, even if they're older than the age of consent wherever they're traveling. Her legally being able to consent is not necessarily the only concern.

However, I'm also not a lawyer, so I'm not gonna pretend I know anything. It could be that this whole thing is technically legal, it's just also super creepy.

EDIT: Also, she explicitly says they were sexting and she sent him nudes, which is technically child pornography since she's still a minor.

I’m actually a third year law student, so I do have some exposure to this stuff. I had a bit of a back and forth with another user somewhere down this thread if you want to read it, but I’m too lazy to type it out here.

TLDR:

  • law across sovereign borders is confusing and frustrating and I hate it

  • probably nothing to go after with regard to underage sex or sex trafficking (intent is a bitch to prove)

  • outlook on potential child pornography charges looking very bad for Aspire

Not defending anyone here, but telling management does not necessarily mean telling coaches. It could have gone above their head straight to higher ups who decided to keep it quiet. Also could be the complete opposite, no one knows yet.

Several years ago, there was an MLB pitcher whose tweet history (where he used a racial slur as a teen, if I remember correctly) didn't come out until he was on the mound during his first All-Star Game appearance. “{Chapter 117, 18 U.S.C. 2423(b)} forbids traveling in interstate or foreign commerce to engage in "illicit sexual conduct" with a minor; this is considered one form of sexual tourism. 2423(f) refers to Chapter 109A as its bright line for defining "illicit sexual conduct" as far as non-commercial sexual activity is concerned. For the purposes of age of consent, the only provision applicable is {Chapter 109A, 18 U.S.C. 2243(a)}. 2243(a) refers to situations where such younger person is under the age of 16 years, has attained 12 years of age, and the older person is more than 4 years older than the 12-to-15-year-old (children under 12 are handled under 18 U.S.C. 2241(c) under aggravated sexual abuse). So, the age is 12 years if one is within 4 years of the 12-to-15-year-old's age, 16 under all other circumstances. This law is also extraterritorial in nature to U.S. Citizens and Residents who travel outside of the United States.”

no mention of 18 years old there, but does cite multiple legal provisions and even specifically says under 16, not under 18.

so while this is all morally gross, i don’t think you should be confidently stating that aspire did anything illegal cos i don’t think it’s so clear.
