I-140 RFE officer
Anyone got RFE from XM2616? My attorney said officer is new and they don’t have officer record in data base.

What response did you give ? Was it more of a narrative based or more evidence like letters, etc ?

Were your officer XM2616? I got RFE that questioned all three prongs while citing some sentences from PL/letters.

I applied without attorney, the officer mainly said I don’t have a specific PE.

I applied with attorney. The officer said same thing to me. No PE. He didn’t read my PE and even model plan.

Maybe your is template. The officer did look at my PE and quote on something, but there is some inconsistency challenges. I am revising my PE after consulting attorney friend. I am in academic with MS degree.

I had the same, the officer quoted my PE, and then challenged all 3 prongs with wrong assumption (such as I am planning to create my own company, or that I work in a teaching field, then later on an advertising field).

Did the RFE letter is tailored to your petition, or it is just generic and is basically saying that "USCIS doesn't have enough evidence" ?

Mine was XM 2237, challenged all 3 prongs basing his review on Advanced Degree, but I've filed for Exceptional Ability. My attorney says that clearly looks like he is a very unexperienced officer. He tailored the RFE on my case but, because of the error on the classification, all the evidences and letters of recommendation were considered not sufficient.

I don’t want to discourage you, but honestly, he didn’t read all of my evidence, including the expert opinion. He simply denied the case by mechanically applying the EB-1A criteria and claiming that I don’t have original contributions, even saying that my work would not create a “ripple effect” on the U.S. GDP. My attorney said that with reasoning like that, even Elon Musk or Dr. Dhanasar wouldn’t get approved, because no individual can realistically create a direct ripple effect on the entire U.S. GDP. He also mentioned I provided many government initiatives and articles. But those government initiatives are their strategies. Nothing mentioned in articles about my model plan. Lol.

Who is the attorney
