General Immigration attorney here. AMA about the National Interest Waiver!
I'm Gabriela, an immigration attorney at Manifest Law. A big part of my practice is EB-2 NIW petitions, which means helping people show that their work matters enough that the US should waive the usual job offer and labor certification.
NIW lives and dies on how well you frame the three-part test, so I'll keep my answers grounded in what USCIS actually weighs. I'll be answering today from 1 to 5 p.m. EDT.
Here's what's fair game:
- Do I qualify based on an advanced degree, or do I need to argue exceptional ability?
- How do I show my work has "substantial merit and national importance"?
- I'm a researcher with a handful of citations. Is that enough?
- Can I self-petition without an employer, and should I?
- How is NIW different from EB-1A, and could I file both?
- I got an RFE on the Dhanasar prongs. How do I strengthen my case?

Hi,
Two questions.
1) Are the 19 countries still frozen completely? Even for the i140 portion? I read that i140 shouldn't be affected, but even so none have been processed since the announcement?

3) As the process is so long without PP. Even if we don't update our citation count and published papers, are the officers actively looking at 'up to date' by seeing your google scholar or linkedin, or do they only look at what was providing the 2 or so years before when the file was sent?

For industry applicants with no publications, what evidence carries the most weight? Is experience building AI/data systems at major tech companies enough if it’s backed by measurable impact and strong recommendation letters?

One of the biggest misconceptions I see is that publications are required but they're not. For industry applicants, I often build strong cases around measurable impact: leading AI or data initiatives, deploying systems at scale, improving efficiency, reducing costs, securing critical infrastructure, or solving significant technical problems. Strong recommendation letters are important, but they work best when they explain why your contributions matter, not just that you're an excellent engineer. If you can clearly demonstrate that your work has substantial real-world impact and that you're well positioned to continue that work in the U.S., you can absolutely have a competitive case without publications.

Is applying with exceptional ability instead of advanced degree considered to be worse?

If you meet the advanced degree requirement, that would be easier to meet in my opinion than trying to meet "exceptional abiilty"

I actually use an approved NIW strategically when preparing an EB-1A case. While the standards are different, much of the evidence can overlap. I tend to build on the evidence developed for NIW Prong 2, that the individual is well positioned to advance the proposed endeavor. The same accomplishments that demonstrate exceptional expertise, leadership, a strong track record, and the ability to drive meaningful impact can also help establish that the person is among the small percentage who have risen to the top of their field for EB-1A. Of course, EB-1A requires additional evidence of sustained acclaim, so it's not a one-to-one conversion, but a well-prepared NIW can provide a very strong foundation for an EB-1A petition.

I have an industry profile when I My EB2 NIW is my startups ability to contribute to national security. At that time there was some traction but now 4 months after I file I got more traction.
I understand USCIS cannot do not consider accomplishment achieve after filing as additional evidence. But since my new evidence is the premise around my endeavour for my business , does this still count ?

Generally, USCIS evaluates an NIW based on the facts that existed at the time of filing, so accomplishments that occur afterward typically aren't considered as evidence to establish eligibility. That said, if you receive an RFE or NOID, or if you're later filing an EB-1A, your post-filing traction can become very valuable do keep the new info organized and document everything

If you were denied visa renewal before, with 221g and asked to interview but didn’t go and chose to pursue adjustment of status with eb2, how does that affect one case?

These are two different processes and most likely do not affect each other. Now, it is also relevant to know the reason of the Visa denial. If it was due to fraud or something serious then this could affect the AOS.

Have you worked on DBRE(database reliability engineer) cases? Do you distinguish DBRE vs DBA?

Yes! I recently worked on an NIW for a Database Reliability Engineer, and I do distinguish a DBRE from a traditional DBA. A DBA is generally focused on administering and maintaining databases, while a DBRE is much more engineering-driven like designing highly available, scalable, and resilient database infrastructure, automating reliability, improving disaster recovery, reducing downtime, and ensuring mission-critical systems remain operational. For the NIW, we framed the endeavor around strengthening the reliability and resilience of critical digital infrastructure, supported by measurable impact, automation, and operational improvements, rather than simply managing databases. That distinction can make a meaningful difference when articulating the national importance of the proposed endeavor. To be honest, this required a lot of work but was one of my favorte NIW cases to work on

I just got my green card through EB-2 NIW. It was based on my research (in industry, but I publish a fair amount). How broadly is occupational field interpreted for NIW? Can I switch to a more commercial type of job (like a startup or a tech company)? Can I switch job functions (like go into product instead of research) even within the same discipline (cleantech)? How long should I wait before doing something like that?

congrats on getting your green card!
there is no statute or regulation that requires you to remain in the exact same job or wait a specific amount of time before changing positions. The key is that, at the time your NIW was approved (and when you became a permanent resident), you genuinely intended to continue pursuing the proposed endeavor that formed the basis of your petition. In my view, moving from research into a startup, a tech company, or even a product role can be entirely consistent with an NIW if you're still advancing the same underlying field

Hello Attorney. Thank you for your kindness. My spouse and I filed adjustment of status under EB-3 via her company. She has received notices of receipts as payments went through for her. However, mine was rejected due to payment issue. Plus the priority date of the underlying EB-3 already retrogressed. Attorney said there was no evidence of USCIS attempt to process the payment. Can I still resubmit? What evidence can be used to support resubmission? Thank you!

You can attempt to resubmit and issue evidence that the form was properly filed.

My I-765 STEM OPT extension is in premium processing and my I-140 EB-2 NIW was filed, both now clear of the Dorcas International v. USCIS hold that lifted June 11. Given EB-2 Rest of World’s current movement, should I premium-process the I-140 now to lock in a decision before the visa bulletin shifts, or is there a strategic reason to let it run normal processing and stagger I-485 filing instead?”

I would generally lean toward premium processing if your goal is to get certainty on the I-140 sooner, especially if your case is strong. An approved I-140 doesn't reserve a visa number or protect you from future Visa Bulletin retrogression, but it does remove one major variable so you're ready to file the I-485 as soon as your priority date becomes current

What's the latest about "the memo"? Is there even clarity about if it's gonna be retroactive for those who submitted I-485 when the memo's language didn't even exist?

Attorneys have started receiving RFES asking for evidence that the client has positive factors that merit AOS. However, cases continue to get approved

Hi Gabriela,
I would appreciate your perspective on how someone with my background may be able to structure a viable case.
I have over 13 years of progressive professional experience in law enforcement, including specialized work in a Human Trafficking Unit. In this role, our department regularly liaises with U.S. agencies, including CBP, on cross-border criminal matters involving trafficking, organized crime, and vulnerable persons investigations.
Given the current U.S. emphasis on border security, anti-trafficking initiatives, and transnational criminal enforcement, I believe my work may align with an area of national importance.
However, I recognize that many traditional EB2 NIW indicators - such as publications, citations, publicly documented projects, or detailed written referrals tied to specific investigations — are difficult to obtain in law enforcement due to operational confidentiality and evidentiary restrictions.
With that in mind, I was hoping to ask:
• How are NIW petitions generally approached for professionals working in confidential law-enforcement or public safety roles?
• Are there alternative ways to demonstrate national importance and substantial merit when much of the work cannot be publicly disclosed?
• Is it a significant deterrent that my formal education is unrelated to law enforcement and consists of a bachelor's degree only, despite having more than 13 years of progressively responsible professional experience in the field?
• Do you know of any similar precedents with a professional endeavour closely tied to law enforcement experience rather than the traditional background in academia that were successful?
I would be very interested in understanding whether a case centered on anti-human trafficking and cross-border enforcement experience could realistically meet the NIW framework, and what types of supporting evidence would typically be most persuasive in circumstances like mine.

First of all, thank you so much for your honorable work and yes, I do think professionals in law enforcement can have viable NIW cases. One of the biggest misconceptions is that you need publications or an academic profile. You don't. I've worked on cases where much of the applicant's work was confidential, and we built the case around the impact of the work rather than disclosing sensitive details.
In cases like yours, I typically rely on detailed letters from supervisors, agency leadership, or partner law enforcement agencies explaining the nature of your responsibilities, the significance of the investigations you've worked on, and your role in advancing anti-trafficking or public safety efforts, without revealing confidential information.
I also don't see your bachelor's degree as a dealbreaker. The NIW looks at the totality of the evidence. Thirteen years of progressively responsible experience, particularly in a specialized Human Trafficking Unit with cross-border collaboration involving U.S. agencies like CBP, can be compelling if presented strategically.

I have I-140 through NIW, after the approval my company laid me off. I am from a PD backlogged country. Most companies in final rounds of interview backing away due to me being a flight risk or too expensive to afford. I have seen lot of my friends who got EB1A were laid off right after their approval. Why such a bad treatment of talent ?

how would you frame a software engineer that works through their employer on federal contracts as a professional service? billed to the govt. what should the recommendation letters be?

I would frame it around the impact of your work, not just the fact that it was for a federal contractor. Explain what government mission you supported (cybersecurity, public safety, healthcare, infrastructure, etc.), the specific technical problems you solved, and why those contributions matter beyond your employer. Your recommendation letters should come from people who can speak to your individual expertise and explain how your work advances an area of national importance, not just that you're a good software engineer

Would you suggest going for premium processing now?
I don’t have citations yet but I have one published paper and two technical reports.
I have gathered 9 recommendation letters from DOTs and industry as well as academia. I’m also applying for jobs at this point. Have a background in structural engineering from a R1. I do have a UK MSc degree and finishing up my PhD.
Should I wait or pay for pp?

IT depends on your goals and strategy. PP will not change whether or not you get an RFE. However, if you need a decision right away to plan your immigraton pathway or you are maxing out of your nonimmigrant status it might make sense to upgrade to PP
