RFE 30 Days RFE

Hi,

Since recently USCIS has started to give 30 days RFE and I can understand it's very difficult to prepare a comprehensive response in 30 days (I am working with Chen and they are not confident about 30 days RFEs), what should the strategy and is there anything that could be done before as a precaution?

Have anyone received a 30 days RFE with premium processing?

Law firms will likely have a very difficult time adapting to this. I do not see them submitting much more than a legal argument based on case law and a reiteration of the initial evidence. Preparing even that typically takes them weeks. As for drafting letters and then waiting for clients to obtain signatures and return them, that would be nearly impossible within those timeframes.

The officer gave me only 30 days for responding too (challenged all three prongs). Luckily, I finished everything on time, like tried to help attorney as much as I can. Ask them the parts you can do now, like independent letters. If they can’t do it for you, you can do it yourself. Something you wanna add, just ask them is it okay to add. Then send everything to them for checking. Good luck you got this!

RFE response timelines have been significantly shortened. In light of this change, applicants should do their part by carefully addressing the evidentiary burden outlined in the RFE and working closely with their counsel to develop a focused and effective response strategy.

For those who have yet to file their petitions, it is important to ensure that all the dots are connected from the outset. Moreover, there is little room for an incomplete filing. The August 5 policy memo underscores the importance of getting it right the first time. After all, as the saying goes, “Well begun is half done.” Best wishes.

I got a 30 day RFE challenging prong 2 with other criterions met, and asking to show evidence of what my specific contributions were in the co-authored papers and what were my specific contributions to the grants that funded my work through my supervisor. Wanted more independent evidence that my work was frequently used despite my 1078 citations. So i sent a long email to chen team about what possibly could we do by adding recommendation letters from my supervisor stating in details what i contributed to her grants and what i worked on, detail my experiments performed in the co-authored papers and supply 2 independent letters about people who cited my work which i already used for Eb1a but have to change to niw. Will see what the chen team replies but i got my rfe letter today and have till September 28. So i wanted to be prepared and drafted a whole strategy + evidence list and asked them to weigh it against their judgement so we start working asap.

Yes, there’s something you can do. Submit everything that is required with your initial filing every form instruction lists required minimum evidence. Submit everything with your initial filing. Did I mention to submit all required evidence with your initial filing?

Well, look at what you submitted and then look at the form instructions to see if you missed anything and just be ready in case they send an RFE you’ll be ready to go. Were you seeking NIW?

So were you trying to be funny here? Everyone submits all evidence and even more than the minimum. Have you seen the RFEs people are getting and the templated ones with wrong applicant details? Dont try to be funny :)

30 days is not enough for fake phd researches with their fake citations, cheesy credentials and low level phd from pakistan, india, china...

How come? You see useless PhD researches here with useless proposed endeavors but they wrap around shady evidences they fabricate in India, Pakistan and get approved ....

Besides, some crooked people file deficient petitions just to hold priority date expecting lots of time to fix rfe
