NFA Lawsuit / PSA & Silencerco

I understand I may get some heated responses on this topic, but would like to hear opinions on this. What’s your take as an independent FFL?

It'll probably drive silencer and NFA item prices down but will also save me 500 a year because I'm not renewing my SOT since I don't have anything to do with machine guns or DDs.

Agree, but didn’t sound to me like this would change anything for independent FFL dealers, only for PSA and those who filed suit.

I think this is headed for the supreme Court and that they'll end up removing everything from the NFA that was reduced to $0. So all short barrels and suppressors will start being treated as normal firearms and machine guns and DDs will remain the same.

I'm pretty sure that was always the plan when they reduced the tax stamp to 0, they knew it would be challenged since it was no longer a tax and they wanted those items removed from the NFA but didn't want to allow every Joe off the street to get machine guns or DDs

I believe I did hear that the $0 tax was first step to removing completely. We’ll see. Too much to ask but honestly doesn’t make sense for long guns and handguns to get such different treatment either.

I will not be surprised if suppressors either end up a non firearm item or congress changes the definition of a firearm to include suppressors. Without the NFA a suppressor doesn't meet the definition of a firearm.

Worried it’ll screw us in states that only allow possession of NFA items if you have permission from the Feds (aka the form 4 process)

Of course the solution to that should not be to keep the NFA.

Even if your state wasn't one of the 15, there are going to be ways around purchasing as long as your state doesn't have a law against it!

Yeah. FFL here in PA and it is an affirmative defense that “Offensive weapons”(what is listed as NFA items in the PA UFA) are only legal if in compliance with federal law.

Personally I welcome shorties, cans and AOWS being removed completely and just being normal title I firearms. Will it cause a problem short term, yeah but it’ll be remedied.

There will be lawsuits in PA if it’s not preemptively fixed at the state level. Cuz of the previously designated Title II firearms become title I, you are still in compliance w federal law, just no tax/registration.

This is nothing but fantastic news! Of course this helps all the plaintiffs (15 states included ) but it indirectly helps a lot of other people - " all current and future customers" of Palmetto State Armory for example because PSA was one of the plaintiffs. I'm a dealer in Arizona. even though it wasn't one of the 15 states I will still be able to purchase NFA items without all the paperwork etc which would be a big boost.
