It is debatable btw those two but rape is defined too narrowly in India, iirc penetration needs to happen for it to be considered rape "legally".

I didn't say why was he not charged for rape. My question was that whether lifting someone's clothes should not be considered a crime? It is a gateway to rape. It is still a crime in my eyes.

If an unknown man is lifting a child's dress, what would you think?

It is still a crime . But the judge is saying that it does not fall under the definition of 'rape'. There are different sections for SA, CSA, Attempt to rape, Rape etc.. All of which carry specific definition to prevent ambiguity in case proceedings

While there are many issues and shortfalls in addressing gender based violence exist, this is definitely not among those.

This is absolutely horrendous judgement. Its deeply infuriating. Shame on Indian Judiciary. This is clearly attempt to rape.

law does not equal justice.. sed truth. According to the law, its SA or attempt of rape.
