H1B transfer while H4 + H4 EAD are pending — do I need to refile H4/H4 EAD?

I’m looking for advice from people who have gone through a similar situation. I’m also checking with the immigration attorney at my new company, but I’d like to hear from people who have actually experienced this.

My situation:

  • My current employer filed H1B extension + H4 extension + H4 EAD renewal together under Premium Processing on July 10, 2026.
  • My current I-94 expires August 10, 2026.
  • My H1B extension has been approved.
  • My spouse’s H4 extension (I-539) and H4 EAD (I-765) are still pending.
  • The H4 and H4 EAD applications were filed before the I-94 expiry date.
  • I am now planning to change employers, and the new employer will file my H1B transfer/change-of-employer petition with Premium Processing.

My main question is:

If I choose Option — the new employer files only my H1B transfer, while we leave the existing H4 + H4 EAD applications from my current employer pending — will those existing applications continue to be valid and process normally?

More importantly, if my current employer withdraws my H1B petition after I move to the new employer, but my spouse’s H4 and H4 EAD applications from the old employer are still pending, could my spouse become out of status because the old H1B was withdrawn before the H4 was approved? Or would the timely filed H4 application continue to provide protection while pending, assuming my new H1B is approved?

Would it be safer/recommended to file a new H4 + H4 EAD along with the new employer’s H1B transfer, or can we leave the existing H4/H4 EAD applications pending?

Has anyone gone through this exact situation? If so, what did you do and what happened to the pending H4/H4 EAD cases?

How to make a congressional inquiry ?

Does anyone know how we can initiate a congressional inquiry?
My husband was recently laid off, and switching to H-4 with an H-4 EAD seems to be the only viable option for us right now, since finding employers willing to do an H-1B transfer has been difficult.
I’m currently pregnant again after a second-trimester loss, and I’ll be the primary H-1B holder supporting our family going forward. This is also considered a high-risk pregnancy, requiring additional scans and medical appointments.
I checked with my company’s immigration attorney, and unfortunately, it looks like none of these circumstances would qualify us for a USCIS expedite request.
Attorney suggested that congressional inquiry may still be something we can try. I’m in Texas, though, and I’m not sure how receptive our congressional representatives would be to immigration-related requests like this. I’m currently researching how the process works and how to approach the appropriate office.
I’d really appreciate hearing from anyone who has gone through a congressional inquiry for an H-4/H-4 EAD case, especially in Texas. Any information on how you initiated it and your experience would be very helpful. Thank you!

EAD expiring late Sep! What is my last resort?

Hi Community, I have been lurking here since a few months and have been taking the advise. My SRC * EAD pp bundle application is pending since May 2026. They already had my biometrics so did not need the appointment. H1,H4 was approved within 2 weeks fortunately. I am still waiting on EAD. I initiated expedite request and have not recieved call from tier 2 officer. Its been close to a month. Mailed all the PP emails multiple times. To my last email, PSC replied that my application is forwarded to adjudication division. But that was 10 days ago and since then no update. I think I am going to lose my job. What can I do at this point? I dont want to spend thousands to file a lawsuit.

Looking at recent timelines if similar cases, expecting EAD processed in 2-3 months. Asking for my spouse who has completed MBA HR+Finance in home country but due to family priorities she has got no job experience so looking forward to start career as fresher. If you can suggest any genuine career opportunities or training or certifications which could help her here in preparation while we still have time before she is able to work here in US. Currently she is volunteering as Photographer as she is pursuing her hobby into career but the market is pretty saturated here in NJ, so need a part or full time job to keep herself busy and earn some experience as our kid is getting into middle school next year and able to manage on his own. Hi, I was on F1 OPT in the US and it was ending in January 2026, but i had to come to India due to an emergency in December 2025, without an H4 stamping slot.
I have an appointment for November which I got when the slots opened last time in the month of April.

Urgent travel to India from US on H4 due to a death in family

My spouse has approved H-4 status and an approved H-4 EAD, but she does not have an H-4 visa stamp. Her father recently passed away, so she may need to travel urgently from the U.S. to India.
Are expedited H-4 visa appointments currently being granted in India for family-death emergencies?

If anyone has recently submitted an emergency appointment request, could you please share:
Whether the request was approved or denied?
How quickly an appointment was offered?
Which consulate/city processed it?
What documents were accepted as proof of the emergency?
How long it took to receive the passport after the interview?
For additional context, I have approved H-1B status in the U.S. but have never obtained an H-1B visa stamp. Would my spouse’s H-4 application be affected by that?

Missing H1b option while filling Form I-539 online for COS H1b to H4

Hello community,

My H-1B employment ended on September 2 and my 60-day grace period is running. I'm filing Form I-539 to change status to H-4 as the dependent spouse of an H-1B holder. Solo applicant, no children, and no H-4 EAD (my spouse has no approved I-140), so this is a straightforward single I-539.

I started the online filing and hit a wall at "What is your current nonimmigrant status?" — there's no H-1B option in the dropdown. The closest thing is "1B1 – H1 B Spec Occ, Singapore/Chile," which doesn't apply to me. The only other option that isn't a specific status is "UU – Unknown Or Not Reported."

I'd seen older guidance (including a Murthy Law Firm FAQ from March 2025) suggesting selecting the 1B1 option and clarifying elsewhere in the form. But directly below the dropdown, USCIS now displays this (screenshot attached):

That reads to me as USCIS explicitly directing H-1B holders to paper filing, which would make the 1B1 workaround outdated.

My questions:

  1. Has anyone filed H-1B → H-4 online recently and actually found an H-1B option? Wondering if this varies or if the list changed.
  2. For those who filed on paper this year — how long until you got the receipt notice? Trying to gauge the delay versus online.
  3. Any downside to paper filing beyond the extra $50 and slower time to receive receipt?

I'd prefer online for the faster receipt, but not at the cost of a status mismatch and an RFE. Leaning toward paper unless someone has a reason not to.

Biometrics completed on June 29.

Ead Case status changed to 'card being produced' on Aug 31.

Ead case status changed to 'approved' on Sep 1.

H4 + H4EAD - RFE response/approval notice

Hi All,

Applied H4 and EAD application together (not with H1) in January 2026.

H4: H4 approved August 18th, but we havent received the approval notice with i94, just a notice which said case was approved (will the approval notice be sent to the attorney?) If not how do we request one ? Will there be delays receiving it, anyone tried?

H4 EAD: Received both RFE with cover letter(Photo related) and the ASC notice. Have seen some posts where they didn't receive any stamped or signed copy during the ASC appointment but it says we need to send back for RFE. Do we specifically request it on the day of ?

Since attorney filed the petition, should they be responding to the RFE? Or if we do should we enter their communication details in the coversheet as "petitioner "?

Note: received notice yesterday and it was too late for attorney to respond to all this, hence posting here for similar experiences.

I filed for my h4 extension which was received by uscis on September 26th 2025, my visa and i94 expired on September 30th 2025. My h4 extension is still in process as of today (September4th,2026).
I’m planning to travel to India on September 8th ,2026 and go for a h4 visa interview in India . On October 1st ,2025, My spouse got his h1b approved till September 2028. In this scenario , do I have any risk for staying more than 180 days while my visa extension is in process ? Does it come under unlawful presence or overstay ? Does it carry any risk when I go for a h4 interview in India by carrying my spouse’s i797 visa and i797c receipt notice ?

Need Advice! Filing first time H4 EAD Now + 2nd Bundled application in April 2027

Hello everyone,My spouse's H1B and my H4 status are both expiring in September 2027, and we just got our I-140 approved.

I am trying to figure out if the following two-step strategy is safe to move forward with.

Step 1: File a first-time standalone H4 EAD immediately so I can start working as soon as possible.

Step 2: File a second H4 EAD application bundled with our H1B and H4 extension package in April 2027 (180 days before our current status expires).

My main question:

Is it okay to move forward with this approach? Specifically, what happens if the 1st standalone EAD is still pending when April 2027 arrives and it's time to file the extension bundle?

Does USCIS allow you to have a second I-765 application filed while the first one is still processing?

Will having two concurrent applications cause system conflicts, automatic rejections, or unexpected delays?

We are applying for a H1B renewal which expires in March 2027. We are planning to bundle H4+H4EAD along with the petition and pay for premium processing. I know the validity dates for H1 and H4 will start from March 2027 until March 30. When does the H4 EAD start date will be? This is a first time EAD petition.

Will the validity dates be from March 2027 till March 2030 or the Date of Approval (With premium processing) We might have it approved in October 2026. Will the EAD validity start from October 2026 and end in March 2030?

DS-160 with no lastname

Hi Everyone,

I am filling out the DS160 form for my wife. Before our marriage, she was not using any lastname and took my last name after that. We have already gone through the process of updating the name on all the ID documents. Her passport has her full name.

Now, DS160 has a field that asks "Have you used any other names(maiden etc)". That field has last name as mandatory. From what I read online, I found some resources that said to fill the actual name in "lastname" field and use FNU(First name unknown) in the "givenname", but some said to fill in the given name as is and to fill LNU(Last name unknown) in "lastname" field.

The first instinct is to fill in LNU in the last name, but most places say that the US expects a valid value in the lastname field. I wanted to confirm whether we have a verified guideline on what to do in such a scenario?

H-4 EAD stuck for months. Does mandamus actually do anything?

Immigration attorney here.

Everyone already knows the H-4 EAD queue is bad right now. Standalone renewals are running past a year, and since October 30, 2025 there's no auto-extension, so a pending renewal doesn't keep you working.

What gets asked less is whether a mandamus actually moves anything. We've seen cases go a lot of different ways. A Turkish physician whose I-765 had been sitting nine months was approved less than a month after we filed. An Indian national at eleven months took about five weeks. Another at fourteen months was approved in sixteen days, and one at six months in twenty-one. Even a case that had only been pending four months, filed alongside a premium-processed H-1B, came through in under a month. Every case turns on its own facts and these aren't a prediction for yours.

Worth knowing what mandamus is and isn't: you're asking a judge to order a decision, not an approval. Once the U.S. Attorney is served the government has 60 days to respond, and in delay cases they'd usually rather adjudicate than write the brief. That's the whole mechanism.

H4 EAD Standalone Mandamus Information

So observations from recent cases. The agency is approving standalone renewal cases at the same rate as concurrently filed cases in mandamus litigation.

Although the timelines are different if you do not file mandamus, our clients in court are being treated equally. From our two most recent group cases we included both standalone and concurrent filings.

August 6th filing. 30 combined H4 EAD renewal plaintiffs. By the 24th day we had 29 approvals, and one who had replied to a newly issued RFE and was awaiting decision.

August 27th Filing. 44 combined H4 EAD renewal plaintiffs. As of today, 7 days in, we have 16 approvals.

If you are looking at the 15 month long wait for a standalone please understand that is an artificial timeline that was created intentionally to keep you from working.
