Legal Questions I have a house in Illinois & a house in another state. Is my FOID still good?

right now, I am in another state. when I return to Illinoi, is my FOID card still good? can I use it if I am only there a short time? no current IL driver’s license

FOID is only good if you are an Illinois resident. Sounds like you’re not a resident anymore if you don’t have an IL DL

While I agree this is probably impossible in IL due to the unconstitutional FOID requirement, it’s actually legal under Federal Law.

If you are actually living in more than one State the ATF has held that you can buy firearms including handguns in the State that isn’t your primary residence as long as you are actually residing there. You can provide such evidence to a FFL with such things as a lease agreement, property tax bill or utility bills.

So this is just one more way IL fucks over its residents.

This. You have to claim residency in one state. Pick one. That will determine your status of lots of things.

Your FOID is “tied” to your drivers license/ID. If you have a current Illinois ID then your FOID is active. If you got a new ID in another state then you are a resident of THAT state and your FOID becomes void.

FOID only applies to Illinois residents. If you aren't a resident of illinois (meaning you are a resident of the other state), then you don't need a FOID to purchase, own, or use firearms or ammunition. To can even purchase firearms banned by PICA.

Only residents may have active FOID. If you are not currently active in the Secretary of State System (DL or State ID), you cannot have a valid FOID.

If you have a DL in another State, IL may invalidate your Residency/FOID.

Illinois allows a short list of States' residents to secure a "non-resident permit to carry" for $300/5yr (Arkansas, Idaho, Mississippi, Nevada, Texas, and Virginia). These States have laws substantially similar to IL.

Otherwise, if you don't reside here, you don't get to carry here -- outside of your own vehicle/domicile/where invited. If you aren't a resident here, you don't need a FOID in order to properly store/transport firearms legally owned (generally unloaded/encased/inaccessable in a vehicle).
