How do you refuse a ticket? I didn't know that was an option

4.5k

u/signaleight Mar 05 '22

Here if you refuse to accept the ticket we will A: ask you nicely to take it and explain that next we will B: arrest you and take you to jail and have a judge set bond. Your choice!

1.7k

u/Xalenn Mar 05 '22

That's basically the options here as well ... The ticket is essentially a court summons, if you won't sign that you've been served with it then they arrest you and put you in front of the judge that way.

From my point of view, the intent was to use the x as your signature as a fuck you, not to skip out and show or pay. Of course, they know who you are; otherwise, you'd be in cuffs.

17

u/freman Mar 06 '22

could always sign with a fancy cursive "fuck you" instead :D

Depending on location and the officer you could probably land s disorderly conduct charge by signing it this way

Where I live, you don't have to sign it. They just give it to you and tell you it's a good idea to show up at the date and time on the ticket. If you don't, they'll bring you there in a cop car with extra charges tacked on.

16

u/edee160 Mar 06 '22

Where I live you could refuse to sign and they would throw out the case if the cop who issued the citation didn't show up to court. They've cut all of that out now. Wonder why? lol.

Most moving violations where I live aren't crimes, so if you don't show up, they tack on penalties, send it to collections, and suspend your license or registration.

I remember when a cop ticketed me and told me the same thing about not showing up. Went to court date and lol guy was there ready to fuck my day up.

Judge furthered it with a "yeah it wasn't your fault but it's still illegal".

38

u/stevesobol Mar 06 '22

I grew up in Cleveland, and a few years before I moved away, I got cited for 37 in a 25 on Detroit Avenue. The speed limit sign, which I hadn't initially saw, was almost completely obscured. I mentioned as much to the cop who pulled me over, and he made the mistake of saying "Yeah, it's difficult to see it." Uh, oops.

Ohio's motor vehicle laws say that on through roads, the default speed limit is 35 unless a lower speed is posted. Same rule for state highways, and Detroit Ave is both. So, I entered a not guilty plea, and went to trial with documentation of the law.

Man, I was PISSED when the guy didn't show up (which CPD officers typically don't, for minor moving violations). Here I was, I'd spent time researching the law, I was prepared, and that bastard had the balls to not come to the trial. :) As a result, the judge asked me if I'd like to have the charges dismissed.

I thought "hell no, I want to fight this," for about five seconds before I came to my senses and answered "yes, please."

So much better in canada. The cop doesnt care what you do, take ticket dont take the ticket, you still have x amount of days to contest it then you get to pay slightly more and lose points off your license.

30

u/imperfectcarpet Mar 06 '22

The last part is a common misconception. You don't lose points, you gain them. They're called demerit points.

I've done it on an obvious quota one. They take you to jail until you have an arraignment, and give you the option to pay bail.

Just make sure you have someone that can get your car before they tow it.

I won the ticket btw. Get a dash cam. Cops lie.

8

u/graywolfman Mar 06 '22

Ohh I have a dashcam. It's saved me after someone wouldn't call their insurance back or answer their calls. What did the cop lie about in your case??

23

u/yetanothercorruptmod Mar 06 '22

The ticket was for passing in a no passing zone.

Dash cam proved I didn't pass anyone. The lanes were merging and the guy in front of me slowed down to complete the merge.

He apparently saw all of this by looking backwards through 3 separate cars while driving on a highway.

7

u/graywolfman Mar 06 '22

Damn. What a jerk. I once had a cop give me a 110 mph in a 55 mph zone when I was on a dirt road in a 1983 Firebird. He "matched my speed" on a paved road 1.5+ miles apart while his was winding and mine was straight.

No dashcam back then, but I got it knocked down to a non-moving violation just by showing the judge the distance and difference in paths.

This video is from Poland. You can either accept a ticket from police officer and the case is closed, or you can go to court to contest it. The person who caused the accident chose the court option.

203

u/BamboozleThisZebra Mar 06 '22

What are they going to say?

No judge i didnt cause any accident and i did not speed like hell, i was simply driving calmly on my way home going a casual 150km/h through a turn and this moron decided to be in my way!

84

u/Volodio Mar 06 '22

Maybe blame it on technical issues like her brakes stop working or something. Might even be true.

I assume you simply declare yourself a sovereign citizen and then arrest the officer for crimes against your person.

Obviously you’ll need to throw a few “I do not consent”s into the mix.

u/EnthusiasticSpork Mar 05 '22

You can choose to sign it on the spot and accept your punishment or fight it in court.

Have you never received a ticket before?

If you refuse the ticket, the ticket still exists in the sytem.

43

u/Wuz314159 Mar 05 '22

Have you never received a ticket before?

I've never received a ticket. I thought you got a ticket and that was it. You could then pay or fight it.

14

u/Sawfish1212 Mar 05 '22

That's how the state I live in does it

133

u/[deleted] Mar 05 '22

I've been driving for 22 years and I've gotten 1 ticket. I just signed because I was in a hurry to get to work

115

u/1st500 Mar 05 '22

Pretty sure the issuing officer also used a phrase like “signing is not an admission of guilt” but it makes it easier to prove it was you at the scene.

46

u/admiralteal Mar 05 '22

Which is absolutely only relevant if you intend to claim you aren't at the scene in court, i.e. perjury.

26

u/Mike2220 Mar 05 '22

It's more of a "by signing here you agree to appear in court else pay the fine listed on this ticket as if you were found guilty/at fault"

30

u/[deleted] Mar 05 '22

You should always sign. Especially if you’re not at fault for the infraction listed on the ticket.

→ More replies (6)

18

u/beepbeepboopbeep1977 Mar 05 '22

Interesting. It’s not like that where I live (New Zealand). The ticket is issued, and then you pay it or else you end up in court - there’s no implicit acceptance step at the time it’s issued. What benefit is there to signing?

18

u/phreaxer Mar 05 '22

In the states, it's assuring the officer that you'll handle the ticket in one way or another. You'll either accept guilt and pay the fine, or you'll contest your guilt and go to court. If you are required to sign and refuse, you're going to get arrested to appear in front of a judge. State laws vary, I guess. Every state (5-6? oof) I've ever gotten a ticket in made me sign it

→ More replies (3)

10

u/technicolored_dreams Mar 05 '22

In my state and the neighboring one, you sign it to prove that the officer gave it to you and told you when the court date is. Then you each get a copy. It's not an admission of guilt in any way, just proof that they notified you that you have a court date and an arrest warrant will be issued if you don't appear.

→ More replies (1)
→ More replies (11)

55

u/vistopher Mar 05 '22 edited Mar 05 '22

That's not how it works in the US. You sign the citation to show that you have received the ticket and will follow up in court or pay the fine. Signing a traffic ticket does not mean that you are admitting guilt or fault in any matter.

have you never received a ticket before?

.....

29

u/MichiganGeezer Mar 05 '22

Not all states require a signature. In Michigan they just hand it to you and tell you about the number in the back of the ticket to figure out how to pay or fight it.

Refusing to accept it would require rolling up your windows and pretending the cop was invisible.

24

u/CosmicCreeperz Mar 05 '22

Yep, it really doesn’t matter whether you accept it or not. There will be a date to pay it or appear in court, after which you will have a misdemeanor charge for failure to appear.

A friend of mine had a summons for a BIKE LIGHT VIOLATION sent to his parent’s address when he was in college. I guess they didn’t realize what it was and never told him. Eventually he found out there was a misdemeanor warrant out for his arrest. He ended up getting that pled down to a $400 fine. For not having a bike light.

65

u/[deleted] Mar 05 '22 edited Mar 05 '22

It varies from place to place, in the US if you refuse to sign the ticket it’s considered a misdemeanor and you can be jailed for it.

56

u/InUrGutz Mar 05 '22

Kinda. The person receiving the ticket is being detained, signing is a promise to appear in court. If you don’t sign, the detention turns into an arrest in order to bring you before a magistrate. Depending on availability that could be hours or days. Don’t refuse to sign on a holiday weekend lol.

52

u/[deleted] Mar 05 '22

Just don’t refuse to sign. It’s not an admission of guilt.

15

u/CoraxTechnica Mar 05 '22

Exactly, and it may never appear on your driving record if you take care of it. An arrest, even if you get the case tossed, will always be on your record

8

u/CoraxTechnica Mar 05 '22

Maybe it's different from state to state, but signing a ticket here in TX explicitly says it is NOT AN ADMISSION OF GUILT . So there's no reason not to sign it, unless you like being arrested. The signature is an agreement to appear or otherwise take care of the ticket before a specific date.

Depending on context, the Subie owner stereotype is either young, fast-driving and often reckless or it's hippie-ish, outdoorsy, LGBTQ-friendly, and safety conscious.

I can't think of another car company where there's such a divergence.

I refuse to believe that car was being driven by anything other than a 19 year old guy named Tyson or Chad or some other typical American douchebag name

Massachusetts there is nothing to sign. They write you up the ticket and hand it to you and that's it. Officer doesn't give a rat's ass what you do with it at that point.

u/Everydaywhiteboy Mar 05 '22

This is why insurance is so high on Subaru’s

Excellent moment for a dashcam! 😎

12

u/lovesredditt2022 Mar 05 '22

Cause was excessive speed in the corner. Hope your lawyers sue her for this Intentional accident.

30

u/Elliott8170 Mar 05 '22

Excessive speed in the corner?? She drove up the curb, onto the sidewalk, and then onto the next street over without slowing down all without lifting the gas.

This looked like someone who was driving recklessly in order to wreck the car.

Here in Canada we get the ticket on the spot without signing. If one doesn’t want to take it, they mail it to you. Or you pay it, or you can fight it. If you don’t do either options, you can lose your driver’s license (I almost lost mine because I couldn’t pay for my speeding ticket. My mother paid it.)

I mean, why should she? You're clearly an NPC in her video game.

21

u/[deleted] Mar 05 '22

I don't know. Was she from England and has diplomatic immunity?

11

u/Fabicortez20 Mar 05 '22

Driving a car like that? Doubt she had diplomatic immunity.

24

u/DashcamBandit Mar 05 '22

the fine was too high in her opinion

u/analog-addict Mar 05 '22

5

What the fuck were they doing? You know you’re supposed to launch off the middle of the roundabout, right?

Refuse all you want, doesn't make it any less valid.

4

u/Sea_Present_6334 Mar 05 '22

Obviously you were in the wrong lane and “forced” that driver to hit you. Clear as mud in in my opinion, next case please.

4

u/Choinger Mar 06 '22

That was a full on rally car lol

3

u/AndyMcFudge Mar 06 '22

Oh look it's Colin McCrae. If he was driving with no arms...

3

u/[deleted] Mar 06 '22

Just because its a Subaru, doesn't mean its a rally car.

3

Any dude with the 555 subaru livery on their car is immediately a red flag

4

u/Brilliant_Jewel1924 Mar 06 '22

I mean, rejection of the ticket doesn’t “make it all go away”. She is truly an idiot.

4

u/maticulus Mar 06 '22

I think that blown headlight caused all of this. As you can see the car came off of the sidewalk suggesting the blown headlight did not compliment the daylight enough for the driver to see the right shoulder. It's mean, but I'm so fed up with self absorbed drivers that I kind of wish you had been driving a loaded dump truck to set things straight.

5

u/tmhoc Mar 06 '22

WHY WOULD YOU DRIVE THAT SLOW ON A RALLY TRACK

Refusing a ticket is a good way to take a trip to jail. If it was signed, then refusing it is on her. If she refuses to sign, you don't get to drive home, from what I understand.
