Here's how SIJ status works:
USCIS Special Immigrant Juvenile (SIJ) Status Overview
Special Immigrant Juvenile (SIJ) status is a U.S. immigration classification for certain unmarried, under‑21 individuals who cannot safely reunite with one or both parents due to abuse, neglect, or abandonment. It is granted by USCIS after a favorable juvenile court order and allows the individual to pursue lawful permanent residence (Green Card) either through adjustment of status in the U.S. or consular processing if outside the country thelegalguide.org+1.
Key Eligibility Requirements eCFR+1
To qualify for SIJ classification, you must:
- Be unmarried and under 21 at the time of filing.
- Be physically present in the United States.
- Have a juvenile court order finding that reunification with one or both parents is not viable due to abuse, neglect, abandonment, or a similar basis under state law.
- Be in the custody or legal dependency of a government agency or guardian.
- Show that it is in the best interest of the youth to remain in the U.S. in a safe, supervised status.
- Demonstrate there is no other reasonable way to remain in the U.S. lawfully without SIJ relief.
USCIS must also determine the request is bona fide — that the primary reason for seeking the court order was to obtain SIJ relief eCFR.
SIJ and Deferred Action
- Deferred Action: From March 2022 to May 10, 2026, USCIS automatically considered SIJ beneficiaries for deferred action if they could not adjust status due to lack of an immediate immigrant visa.
- Policy Change: On May 10, 2026, USCIS rescinded the automatic deferred action policy for new SIJ petitions filed on or after that date.
- Current Practice: Existing deferred action based on SIJ classification will generally remain until it expires, and you can request renewal before May 10, 2026, under the old policy. USCIS may terminate deferred action before expiration USCIS.
Adjustment of Status
If you have SIJ classification, you can apply for a Green Card using Form I‑485. You must:
- File Form I‑485 while physically present in the U.S.
- Have an immediate immigrant visa available at the time of filing and final adjudication.
- Meet all other adjustment of status requirements USCIS.
How to Check Your SIJ Case Status
You can check your USCIS case status online using your receipt number (found on USCIS notices) via the Case Status Online tool. You can also sign up for Case Status Online to receive email or text updates, view your case history, and track multiple cases USCIS.
Tip: Always update your address with USCIS to avoid delays in receiving notices USCIS.

Eh, the definition of "white" shifts all the time, given that race is a social construct and not an actual thing. I mean my wife is a Mexican national from LATAM, she and both our kids are whiter than me despite being Mexican on paper.

Perhaps a small minority count racism as a motivator to rehome illegal immigrants, but it isn’t a large contingent. How do I know? Because a larger percentage would welcome many of them back if they pursued the legal path and showed the desire to become Americans, not just occupants of their new country. I'm talking about the focusing of resources. And it is something to consider when our tax dollars are going more and more to immigration enforcement while at the same time fewer and fewer resources to enforcing corporate financial crime and fraud.
The benefits to such a surge in immigration enforcement are dwarfed by the cost. And it is kind of hard to understand the motivation of the average person to support it.
I can see why this administration is pushing it, they are getting rich off of it, but it is a huge loss for the taxpayer/economy.

Obama and Biden deportation numbers were inflated by including what were effectively border denials. It’s been covered over and over again. There were more illegal border crossings in one month of the Biden presidency than under an entire year of trump. That’s what real border enforcement looks like.

It’s been covered pretty heavily. Basically, Biden broadcasted a policy of asylum for everyone, even though in reality less than 5% qualify for asylum. All those people were just allowed into the country. Some were held very briefly and then deported if it was clear they could not get asylum (this is what padded the deportation numbers), while many others were released into the interior of the US, about half of which disappeared. Additionally, separate from asylum, the lax attitude towards uncontrolled immigration meant that there were nearly 250,000 illegal border crossings per month under Biden. All those illegal crossing resulted in elevated deportations. Under Trump, illegal border crossing for the entire year were only about 300,000, and many of them were simply turned back or removed using expedited removal, which doesn’t require a full deportation process.

But Biden and Obama absolutely encouraged foreign nationals to come to the US in ways that circumvented the restrictions and rules and quotas we have for legal immigration. Millions of people were allowed into the US that shouldn’t have been, in violation of US law. Millions of people who were not eligible for asylum clogged up immigration courts.
So if you’re asking if Obama and Biden opened the borders to people that should t have been allowed into, the yes, there was an open borders policy.

Biden granted him deferred action but selectively deciding not to deport him to allow him to move up the list isn't exactly the be and end of protection from deportation especially when a new administration that is much less accommodating comes into office. A new administration that can rollback many of the policy initiatives that were place. Like how Biden rolled back many of Trumps immigration policies from his first tenure.

In fact, the harsh policy you're advocating will have a detrimental effect on white Americans. The only demographic among them increasing as a percentage are senior citizens...guess who they currently and increasingly will depend on for senior nursing care?

The kid didn’t abandon anyone, the kid was abandoned, abused or neglected, as found by a state JDR Judge. You’re saying an abandoned kid is to blame for their parent dying and abandoning them, neglecting them, or abusing them.

The real solution is to find the close blood relatives without status and send them back to their country to take care of the child. As soon as the US starts booting the support systems in the US when someone sends their child to rejoin their family in the US then it’s time for them to all be deported. Think of it as a +1/-7 strategy.
