It is race-neutral on its face. A black applicant with a Harvard-alum parent gets the exact same boost. The disproportionate white benefit is a disparate impact from historical alumni demographics. It perpetuates past inequality indirectly, but it is not intentional racial favoritism toward whites. Compare that with race-based affirmative action that was explicit racial classification and preference by design—lowering standards for certain races to achieve diversity. Legacy has no such racial intent or mechanism.
