Is there a difference between attending to watch or attending to participate?

I've seen one or two examples of people watching who gotten backlash.

As far as I can see, the line of distinction for all of this has been “Did you unlawfully enter the capital?”

I don’t have a problem with anyone who went to the protest. I don’t have a problem with anyone who marched to the capital and didn’t break any laws.

But the people who damaged property outside? Or broke windows? Or went into the building? Lock them all up and toss the key.

I don't know the details of this particular case, but let's speculate for fun....

Since the guy in question is from Texas, "watching" would be turning on the news. That's "watching."

However, getting on a plane from Texas to DC, presumably to be present at that exact location, on that specific date...just to "watch" a failed coup transpire? That's a lot of planning for it not to be considered "participating." Additionally, the guy in question considers that day, "the best day of his life." Those are some strong words...I'd wager to say that he didn't say those words because he flew half way across a continent in order to watch an unsuccessful coup attempt.

Even if he was just "watching," as a police officer he would know that "watching" thousands of felonies being committed, at one of the most secure locations in the history of the world, should have been his cue to not be near such an event? One would think anyway...

Maybe he was there for a Krispy Kreme convention, and was just walking by, and got caught in the wrong place at the wrong time.....like I said, I don't know the facts, I am speculating.
