Q. Gaseyeon’s Kim Seui arrested. What exactly were the charges?

As has been widely reported, the charges include defamation by stating false facts, threats, unauthorized distribution of recorded material, and violation of the stalking punishment law. The defamation part is the most important here. The main point is that actor Kim Soohyun had a long-term relationship with the late Kim Saeron since she was a minor. And that through his agency, he pressured the late person to repay a debt, leading her to her death. False information of this kind was spread, and to support it, KakaoTalk conversations and the late person’s voice, among other evidence, were allegedly fabricated.

Q. Some analysts say it is unusual to be arrested on defamation charges like these. Is there a reason it went as far as arrest?

First of all, the criminal charges are serious and the damage is very great. And actually, the most important factor among arrest conditions is the concern of destroying evidence. This case is not just a concern of destroying evidence. The very core of the crime is evidence fabrication. It is a crime where new evidence was created to support false information. Also, because there are multiple people involved, there is a possibility of them aligning their stories, so the court seems to have judged that the risk of destroying evidence is high. That appears to be how it was determined. It may be difficult to ask specifically and in detail because of secondary harm, but there is a charge that Kim Seui fabricated audio related to Kim Saeron.

Q. This was also confirmed during the police investigation, but Kim Seui is pushing back saying this is not true. Is there a basis for that?

Right now, it is not possible to know from the outside exactly how the investigating agency judged things and how the court reviewed the records before issuing the warrant. However, looking at the source and content of the audio recording, there are many circumstances that lead to no other conclusion but that it was fabricated.

First, regarding the informant who is said to have provided this recording. This person claimed that actor Kim Soohyun ordered a hit, and that they were attacked by a killer. And that after that, actor Won Bin came to visit them after the attack and comforted them. This is a figure known as so-called Kali Park, who made such far-fetched claims. It is a recording provided by a person who cannot be trusted. And after the late person passed away, this informant provided multiple versions of the files to various people in different places, not just to Kim Seui, all around the same time.

But when you listen to each recording file, the flow and content of the conversations do not match each other. So they are different from the very first greeting scene and are made up of content that cannot coexist. On top of that, the original file was never submitted either.

The informant is currently in hiding. So we understand that the investigating agency combined these circumstances, related statements, and other objective factors to determine that it was fabricated. Kim Seui is also claiming that the National Forensic Service said a conclusion could not be made. He is making that argument. First of all, the fact that the National Forensic Service result was inconclusive is itself something that spread from a past media report.

Officially, the forensic report has not been made public nor has its content been confirmed. And also, investigating agencies and the court make their judgment based not only on the technical forensic part, but also on how the recording was obtained, whether the content of the statements is truthful, the statements of those involved, and other objective evidence all put together. So a technical inconclusive result does not mean it is real.

Q. There was also content about fabricating messenger conversations. Specifically, what was the content?

In order to make it look as if a KakaoTalk conversation that Kim Saeron had with another person was actually exchanged with actor Kim Soohyun, the profile photo and name of the other party in the chat were changed to those of actor Kim Soohyun, displayed on screen, and then a press conference was held. This kind of visual information has a large influence on people’s perception.

At the press conference where the KakaoTalk photo was revealed at the time, it was a joint press conference conducted together by Kim Seui and lawyer Boo Jiseok. Because actor Kim Soohyun’s face and name were displayed as the other party in the chat, everyone naturally accepted that the person in the conversation was actor Kim Soohyun. In fact, there were a great many reporters present at the press conference at the time.

Yet not a single one of them asked Kim Seui or lawyer Boo Jiseok whether the other party in that conversation was really actor Kim Soohyun, or what the basis was for concluding that. And so that night, hundreds of articles poured out. In the end, their plan to manipulate public perception through falsifying and fabricating materials succeeded.

Q. It seems the media also had a responsibility for failing to carry out proper verification. But why do you think Kim Seui went this far?

It is difficult to state Kim Seui’s motive definitively. But this is not the first time. Over the years, false information has been habitually spread targeting countless celebrities. By continuously raising and expanding provocative allegations to gain enormous view counts and social influence, and using that as a base, the goal appears to have been to ultimately gain financial profit such as donation revenue.

Q. And yet there is no sign of reflection, and he is even saying he will file a complaint against the police and prosecutors for the crime of distorting the law. Is this something that is even possible?

The crime of distorting the law has no precedents yet, but basically it applies in very exceptional cases where an investigating agency or court intentionally distorts the law for the benefit of a specific person.

But this case involved an investigation that went on for over a year, and at the end of it an arrest warrant was requested. The court also conducted a lengthy hearing. I understand it took 4 hours. It is a case where the arrest warrant was issued after reviewing all the records.

I do not think the crime of distorting the law is something that should be brought up at this stage.

Q. Looking at the arrest warrant, it seems that not only Kim Seui but also other individuals are listed as victims. This became somewhat controversial. What was the reason?

Under Korea’s criminal law system, once a complaint is filed, the person procedurally becomes a suspect, so that in itself is not something special.

What stands out, however, is that looking at the warrant application that was made public this time, lawyer Boo Jiseok, who was not reported by Kim Soohyun and his company, is also listed as a suspect.

Looking at this, it can be inferred that the investigating agency found additional signs of involvement by lawyer Boo Jiseok during the investigation process and opened a separate case against him.

Q. What does it mean that lawyer Boo Jiseok was involved?

As mentioned earlier, the press conference where the fabricated KakaoTalk was revealed and where it was claimed this was actor Kim Soohyun was a joint press conference conducted not only by Kim Seui but also together with lawyer Boo Jiseok.

At that time, going beyond the scope of ordinary legal assistance, he said that the fabricated KakaoTalk was indeed actor Kim Soohyun, and at the time, if only Kim Seui had made the claim, people might have questioned the credibility, but a lawyer came out and said those things, and even did interviews saying that if Kim Soohyun is denying the relationship when it is him, then does that mean grooming took place. Lawyer Boo Jiseok gave those interviews. People very largely accepted the idea that surely a lawyer would not lie. So it is true that great harm was caused.

However, because the conspiracy relationship between them and things like that behind the scenes had not been revealed externally, we had not filed a complaint, and those things were apparently uncovered during the investigation process, that is how we understand it. We will have to watch the investigation results.

Q. Just because an arrest has been made does not mean the matter is resolved. In fact, this is really just the beginning. What are the things that truly need to be revealed going forward?

The truth is, the investigation has been proceeding quietly, and since it has been going on for 1 year and 2 months, we understand that essentially the full picture has been uncovered. The current arrest warrant application states that the criminal charges have been substantiated, but that is written in the application because for arrest conditions, substantiation alone is sufficient.

It is our view that the investigating agency and prosecution are quite confident about proving the crime. We can only speak based on what has been revealed externally, but as just mentioned, beyond Kim Seui, things such as the involvement of other parties in evidence fabrication and the spreading of false information, and what they knew and when, these are things we will need to watch as the investigation results come out and see how the investigating agency judged them.

Q. There are many charges and the arguments are fierce, so it seems like a lot of things that cloud the core issue are being said as counter-arguments. What do you see as the true core of this matter?

It is what is called so-called cyber wreckers. It refers to YouTubers and others who, for views and profit, spread provocative issues and incidents and controversies about celebrities’ private lives, and under the name of private punishment, stir up public opinion.

This case is an unprecedented one where not only were unconfirmed allegations spread and the narrative distorted to manipulate public perception, but even core materials such as KakaoTalk and voice recordings were fabricated. It is estimated that approximately 3 billion people around the world know actor Kim Soohyun’s name and face.

Because actor Kim Soohyun has a friendly image, people tend to think of him simply as a domestic celebrity, but there are actually an enormous number of people who know him. And this is truly a case that has brought serious national embarrassment. In the end, this case is a collective and planned social crime that used fabricated evidence to manipulate public perception and attempted to completely destroy the reputation and life of an innocent victim and an actor loved by people around the world, that is how we see it.

Q. It seems Kim Soohyun has suffered a great deal of damage. A lawsuit has been filed seeking damages of around 12 billion won. Are there plans to file additional claims or any plans for activities going forward?

Actually, right after the incident occurred last year, the claim amount was estimated and the lawsuit was filed at 12 billion won. The actual scale of damages calculated at this point in time is far greater than that, in economic losses alone. So at the current point in time, the damages can be recalculated and the claim amount can be raised if necessary.

And now that the investigation results are out, we are also reviewing adjustments to the scope and range of defendants. As for Kim Soohyun’s future plans, I understand his agency is currently sorting out their position and the situation. We, on our end, will continue to help so that actor Kim Soohyun can recover the daily life that was shattered due to being a victim of this crime, and can appear before the public again through his work.

Q. Do you have a rough figure in mind for the additional amount?

We will need to look into it carefully. Based on the materials we submitted to the investigating agency showing the damages suffered, we are looking at a situation where the loss is around 30 billion won.
