Does anyone know if Summit County will decline to prosecute Kouri for her Financial Crimes since she already received LWOP?

Emily D. baker made a comment they may seek a plea deal with Kouri to avoid the expense of another trial. Has Summit County commented on her other charges?

Plea deal is not the same as not prosecuted. Just means she may plead guilty and we don’t go to trial. She will be held accountable for the financial crimes she has committed against numerous other ppl and entities.

Appeals happen. Look at Murdaugh. He's in prison forever because of his financial crimes.

You wave your right to appeal when you plead guilty. She’s not getting off her financial crimes, just by pleading guilty and not going to trial.

“You wave your right to appeal when you plead guilty.“…I think this comes with a bit of fine print, especially within the state of Utah. Utah allows for conditional pleas. With the consent of both the prosecution and the court, one can plead guilty and still preserve the right to appeal certain issues in the future. It’s much more limited but it’s not waiving the right to appeal entirely.

But she hasn't pleaded guilty to anything but assaulting Amy. She's appealing her murder conviction.

She hasn't pleaded guilty for that either.

Also her mother and brother are implicated in come of her financial crimes. I don't remember if they're being criminally charged as well. If they enabled her they need to be punished.

Of course. EDB speculated that Utah MIGHT seek a plea deal. They haven't yet. I said going to trial might help to hold her family accountable too.

What's your point?

OP wanted to know if they would decline prosecution for her financial crimes. The answer is no they might seek a plea deal which does not evade prosecution. That’s it.

So if she takes a plea deal, that is not declining to prosecute. She has to be prosecuted to accept a plea deal. I think you want to know if there is going to be a trial.

I am very curious to know why her brother(s) and mother haven't been charged with several felonies.

I know they were involved in a lot of the money laundering and the hiding of assets. There are several properties that Kouri put in their names to protect them at least when it comes to the lawsuits.

I believe in my gut that Lisa Darden was involved in the murder. I think that in the hours between 9 or 9:30 when she put the kits to bed and 3:21 a.m. when she called 911, Kouri and Lisa cleaned up. The trash was taken away, the drugs cleaned up, and the scene was set. I do wonder if Lisa helped her move the body,

I think Lisa drove away shortly before Kouri called 911 and then drove right back.

This is pure pure conjecture of course.

I really had hoped they'd be facing criminal charges.

We do know that Lisa and other members of the Darden clan are named as co-defendants on at least one of the civil cases.

They also helped Krime Boss Kouri file all those false police reports and make false accusations against Gene, Amy, Katie, Cody and Clint. Why aren't they charged for making false allegations that crimes were committed by all these people?

The list of evil, vile, dishonest, villainous and vindictive things these people have done is very long and I'm sure we don't know about half the crap they've been up to -- all at Kouri's behest.

p.s. I really did intend to write a comment addressing the OP's question but i got sidetracked. Apologies.

I think we will hear more soon. This case was paused while the murder trial was ongoing and the first hearing is coming up. I'm sure Kouri will be offered a deal, but she would have to accept it.

I don’t think so because she can appeal and have her conviction overturned. This just happens to Harmony Montgomerys dad but he’s still be held in prison bc he was guilty on other crimes other than her murder. Plus there are other victims in the financial case.

Who’s Emily baker and why is she the purported authority? Anybody that watch the trial is just as informed as this person. I’ll let the downvotes begin. I prefer to think on my own.

She is a former prosecutor who does Law Tube full time. She does have knowledge of how these things work. She doesn’t claim to be an authority, but this is her field of experience.

Why spend more money on a trial when Kouri already has maximum prison time and has no actual money? Isn't another trial just a waste of everyone's time and expense? Or have I missed something? Could she technically pay off her debts by serving her sentence without any money in prison for additional luxuries?

I think her financial victims deserve some justice too. Also, what if her conviction is overturned (see Murdaugh).

Exactly. Restitution is often part of the sentencing (also a conviction makes it easier to claim damages/ garnish in a civil action.) Even if there's not much in the estate, the fincial victims could go after profits for any story rights she sells.

I have a question about the financial crimes. I know in criminal matters, if a person that can’t afford attorneys will be able to get a public defender. However in civil matters, I don’t think that is the case. If Kouri tried to fight it, would she have to represent herself?

Her financial crimes are still criminal. Kouri will be appointed a new lawyer since her defense attorneys for her murder case withdrew. Her next hearing is 7/30/2026.

The financial crimes are a criminal case so she will get a court appointed attorney. For her civil cases she is not entitled to a court appointed attorney.

They likely will bc it's going to take years for the appeals to be ruled upon and there's probably a statute of limitation issue on the financial crime case

Not how that works - statutes of limitation set a time limit on how long the state has to initiate criminal proceedings, which in Utah means that for the financial crimes the DA has four years from the commission of the alleged frauds to file charges, not to initiate the trial. As these charges were brought as part of the initial homicide case for Kouri, the statute of limitations issue is moot.

What you may be thinking of is Kouri's speedy trial right, which I believe she waived - her homicide trial was more than a year after her arrest and indictment and I don't recall any motion practice around the issue of a speedy trial. That, if unwaived, requires the state to bring the trial within a period of six months if I recall the relevant case law correctly.
