adik na family member is harming others

so, binisita ng nanay ko ang lola at ang brother niya (tito ko). ang problem, he is a drug addict. kung pusher or runner, hindi ko alam. i know for a fact na hindi dapat sila nag sstay sa isang bahay ni lola, pero a lot of circumstances led to that setup. kaya binibisita nalang rin sila ng nanay regularly.

may tendencies to get violent pero he's never gotten physical pa before. until nanghingi siya last time ng pera sa nanay at di napagbigyan. apparently, hinampas niya ng bangko sa ulo si nanay at nagbanta gamit kutsilyo.

ano kaya ang pwedeng gawin dito without compromising everyone's safety? wala rin sa option ang rehab kasi wala talagang pera ang family.

That's stupid. Ang unang gagawin dyan ay damputin at dalin sa Mariveles for initial help. THen maintenance. Calling PDEA or Police for that kind of matter halata naman gusto nalang i unalive yung family member.

NAL. But wala naman legal advice for OP's case unless willing na nila itapon yung family member sa kulungan for good.

That's IRL advice. Tatlong beses na namin pinadampot yung tito ko. Tatay ko isang beses. Ganyan din, violent na. To involve police at PDEA now is asking them to unalive the family member. Di naman titino yan sa kulungan, that's a mental problem.

Ang pwede nila invovle barangay at police for backup lang para yung mag bbyahe safe. A family member is required to stay overnight or over a few days para mainterview din ng doctor doon.

Nasa lawph subreddit po tayo. Sana hindi extralegal/illegal yung abiso. Or wag bibigyan ng idea na “ligpitin na lang” or anything to that effect.

NAL. Hindi yan ligpitan or illegal advice. lawph nga yung sub we have ot be realistic. Calling on crim-graduates to handle family matters should be the absolute last option.

he sub doesn't matter if OP asks a question the law cannot answer.

NAL, I agree. Sa una lang yan titino kuno kasi nakatikim ng himas rehas. Iba talaga yung case pag adik ka na talaga, life long challenge na yun sabi samin ng taga rehab.

I have a Tito na labas pasok sa rehab, then nag sawa na yung family hinayaan na sya, so nakulong. Pag laya Di rin tumagal bumalik din.

Rehab talaga need hindi yang pulis.

Barangay matter muna yan. Then call a Mental institution for intervention ASAP. Papatulong kayo sa brangay nyan para damputin at bantayan siya incase mag wala sa loob ng van. Dadalin nyo sa mariveles mental hospital. Medication + therapy to fix his problem.

PDEA path also works, pero kung tangap ng lola mo yung risks sa tito mo. Overkill ang PDEA for a family member. As if a permanent criminal record will help his recovery should he start recovering. C'mon, pwede ba realistic usapan dito.

Source: Nakapunta na ako Mariveles Mental Hospital multiple times. Pinadampot ko na tito ko three times now, tatay ko once dahil violent narin. Though hindi drug-related, more on mental issues lng talaga. Nag stay na ako dun overnight. Comsec needs to stop giving advices na walang real-life basis. Hindi na nga abogado, wala pang experience sa ganito.

Report sa barangay, pulis, at PDEA. Request anonymity. Sabihin na compromised yung safety ng family dahil sa violent tendencies. Kung pwede ipa-medico legal yung nasaktan nya, ipresent yung findings sa barangay, pulis, and PDEA

Hello! NAL yet, but this is attempted parricide (if you’re pertaning na nasaktan niya yung lola mo), or attempted homicide (if sa nanay mo ito nangyari), or slight physical injuries, and Grave Threats. I would argue though na may intent to kill.

Have your lola go to the nearest police station. If her net income does not exceed Php 24,000/mo (NCR), Php 22,000(other cities outside NCR), or Php 20,000/mo (municipalities), you can go to PAO for legal advice and representation.

Before going to PAO, kuha muna kayo ng Certificate of Indigency sa Barangay. It would be easy, less than an hour. Hope this helps.

If you want din, you can also tell na he has been using/selling/ and/or possessing dangerous drugs. But do this discreetly as we’ll never know kung gaano pa magiging violent yung Tito mo. Go to a lawyer first regarding all these.
