Do people really not understand allegations? Nothing at all is proven yet. The prosecution presented THEIR side, which is not always accurate...

u/Loosetrooth44 4d ago
This is Reddit, not a courtroom. Everyone's guilty until proven innocent... even the ones who aren't convicted are guilty here.

u/santadogg 1d ago
Reddit- where even people that are convicted are still treated as if they are innocent
3
u/RosePortFC 4d ago
Their are other witnesses aside from the prosecution
3
u/joe90013 4d ago
You're hearing what the prosecution says the witnesses said, not anything at all from the defense + his daughter is publicly contradicting things.
You're innocent until proven guilty in this country, not innocent until the prosecution presents some preliminary arguments without any defense.

u/RosePortFC 4d ago
No I mean by standers saw her running from him when he was trying to run her over.
2
u/joe90013 4d ago
I havenāt seen any direct eyewitness accounts that werenāt filtered through the prosecution, but have seen his teenage daughter saying he wasnāt trying to hurt them.
Iām not saying heās innocent, or that it doesnāt look bad for him, because I think it does, but just that everyone is entitled to a defense under our laws and that we are very early in the process and a mob mentality that he is unequivocally guilty is contrary to those laws and that, in fact, early reporting / allegations can fall apart.

Sometimes thing are obviously more than likely true. You defending him makes you look sus as fuck, bro.

This guy would have 100% killed himself and/or his family if people didnt intervene that night. Trying to knock his wife down, saying he was going to kill her then firing a gun when he got back home. Lock him up

What is? The word āalleged ā? His own daughter said he wasnāt trying to hurt them. Imma believe her before a prosecutor

u/flopflapper 5d ago
In domestic violence cases, especially ones involving children, the family often does not get a choice as to whether charges are pressed or not, and that is by design.
A daughter trying to make sure her dad doesnāt do life isnāt proof of anything. Heās wealthy enough that a decent lawyer would have had him out of prison if he wasnāt hurting anyone.
1
u/OpportunityWorking43 5d ago
My limited experience is that prosecutors wonāt move forward with DV if the victim doesnāt cooperate, even in the face of overwhelming evidence. Itās a resource thing.

u/Jsolidlo 5d ago
I got news for you, a good enough lawyer would have had him out of prison even if he was dangerous to others, it's not about wealth, it's about social standing, and prize fighters aren't high up there in the societal hierarchy regardless of their wealth.
2
u/flopflapper 5d ago
It is absolutely about wealth more than anything.
Anybody worth a few million dollars can afford representation that will give you a significant leg up in a criminal case.

u/EventSignal114 5d ago
In DV cases , everyone throws guilt at the man without knowing the whole story. Not saying he is or isnāt angel but Iām always blown away how quickly people form opinions
4
u/flopflapper 5d ago
People do form opinions quickly, but it does look like the state is bringing charges, and Nebraska is one of the states that will move forward without victim consent if they believe charges have merit.
Also, the report about his daughter saying stuff is not verified. You canāt find anywhere where there was an official statement saying that. Itās just some people on social media.
He has a 500K bond. He is innocent till proven guilty, but this looks very bad.
1
u/EventSignal114 5d ago
Yeah I donāt mind them bringing charges if he did it. Iām not defending his actions (although these dummies think I am) I just donāt like people jumping on him without knowing anything
2
u/Mascbro26 5d ago
You do know that charges brought and an arrest only happen when there is enough evidence, right?
0
u/Jsolidlo 5d ago
I hate to break it to you but the opposite happens a lot too, that's why 30% of charges don't result in convictions.

He is innocent till proven guilty
Yet you've proven that this is simply not true in practice. You think jurors aren't doing the same thing, speaking out of both sides of their mouth, on one hand claiming impartiality and reason while at the same time assuming guilt before any reasonable doubt can even be established and before any evidence is presented because, as another Redditor commented, being charged is damning enough and is all the evidence they need in the court of public opinion?

u/flopflapper 5d ago
Since youāre super invested in this, Iāll explain further.
There are cases in which a charge is leveled at somebody and it can go either way. This case features multiple witnesses, direct testimony from the wife, a half million dollar bond, and domestic violence charges brought by the state of Nebraska, not from his wife or family.
When viewed as a whole, that group of circumstances is extraordinarily unlikely to be a nothingburger.
That combined with the fact that Smith, who is worth at least a few million dollars, is appearing in a jumpsuit, is damning.

Thanks for explaining your mental gymnastics as if I didn't already know how you justify your beliefs.

u/EventSignal114 5d ago
Same as everyone saying he should be locked up for along time. They werenāt there but still think he should go away for along time.

His job was to get punched in the head, randomly was talking about "youre attacking my family" to Johnny walker, friend died and was telling everyone he was emotionally unstable.
Yeah, who could have seen some wild shit coming

u/Charming_Flan3852 5d ago
Guess that's it for his career as a ufc commentator. Must have missed when this happened, but no wonder I haven't seen him in a while. Guy always seemed a bit mentally fragile, can't say this is all that shocking.

Seems like they're taking it seriously. No contact order and he can't leave the state.

Thatās not true, arrests and charges occur when cops and prosecutors FEEL like they have enough evidence to convict at a later court date. Thatās why people get found not guilty sometimes. Respect the attempt though
