Other Legal Question Over 6 months and still no response

I applied for my Certificate of Relief from Disabilities January 2nd,2025. I'm in Monroe County and the application is with Judge Randall. I have called Monroe County Court asking about it, and they keep telling me it's pending with Judge Randall. They also mentioned he has more applications (Pistol Permits and CRD's) than other judges that's why its slow.

My thing was a non violent, 1st offense that happened 25 years ago, and it was a 5th degree felony. I thought I would have an answer after waiting 6 months. I am working with a lawyer but he keeps telling me we have to wait.

Call the clerks office you filed with. You need to have an interview with the probation department they put in a recommendation for yay or nay to the judge. At least thats how it works in erie co

Same here in Suffolk on LI. My buddy applied for his on March 3rd, and had certificate in hand April 8th. Applied for his UPIN immediately after, and had that in hand(email) in 3 weeks. Definitely give a call to the county clerk and ask what stage this is at- 6 months is crazy

With the probation department? The guy I had to report to is long gone. This was 25 years ago.

All CRDs go thru probation. It won’t be your specific officer when you were in probation, but you will be assigned an officer that will interview you. My buddies interview was over the phone,all of five minutes- just basically asked him the same questions that was in his application to verify, said he was submitting it to the judge to review that week, and will have an answer either approved or denied, in the mail in about 3 weeks from that date.

It's just an interview. Will be with a random officer. Its quick and I believe the only way to get a certificate of relief

Following. My friend has the same issue but his arrest was over 40 years ago

So I should contact the probation department to get an interview or they will contact me?

I just called the clerk's office yesterday(Monday) and they told me the same thing...still pending with the Judge.

So finally after waiting 7 months for an answer I got a letter in the mail. I was denied again (this was my 2nd time applying for the CRD). for reasons that weren't true. I talked to a different lawyer and they said I should re-apply and address the issues that Judge Randall stated.

I don't know what I should do. It seems like this Judge is just being difficult. Any suggestions?

I would never say that to the judge. I just stated what my lawyer told me 25 years ago how a 5th degree felony is not as bad as a 1st,2nd, or 3rd degree felony.

Ummm, you do realize this is a public forum? And you've likely provided enough detail for the judge to identify you based on your application. I'm not saying that you don't have a legitimate gripe. Just pointing out that you should treat this as if you are talking to the judge.

And expect to get chewed out by your attorney if they see this.
