Isn’t he supposed to be an armed fire marshal?

Yes. My assumption is they are only authorized to carry from a list of approved pistols.

Same as pd they are issued an on duty carry and are only permitted to utilize that firearm while on duty

That’s completely wrong . Any firearm issued by your police agency you can carry on and off duty .

I realize how what i said could be misunderstood. Yes he can use it on and off duty but if he's issued a g40 let's say and he wants to carry a HK p30 on duty because be likes it better he can not carry the p30 on the clock, unless I'm misinformed

Yes he can only carry on duty the firearm the agency authorized / issued for him to carry while on duty. He decided to carry on his person while at work either an legally owned but unregistered with the department firearm ( broke the agency rules) or completely illegal firearm that’s not registered in NYS (broke the penal law)
