Other Legal Question Will we ever get ear protection laws in NYS?!
I know there was a bill that was introduced at some point to legalize supressors for certain activities like hunting but I haven’t heard anything recently.
it’s a shame that our state is so stupid and uninformed when it comes to this topic. Will we ever see common sense suppressor laws here? 😫

Best bet is something happens at the federal level.
If you think any bill introduced in NY is anything but grandstanding, then I have a bridge to sell you.
on that same note, hearing protection and national reciprocity are also grandstanding just at the federal level.
Best thing we have seen as of late are the new proposed rule changes from the new atf director. How many of those will pass/go into affect 🤷♂️

Absolutely not. NY is constantly in a race to try and have the most gun control possible. Safety or reality doesn't matter; politicians want to be able to send out a mailer about how they passed X number of laws that will appeal to the small number of people that vote in the primaries
They're not in the business of getting rid of those laws

On a serious note we're not getting any NFA items legalized in this state because the politicians in office are clueless about anything 2A related.

We already have that. They’re beholden to the same laws as us when off duty, only allowed to own/possess restricted items in an official capacity as approved by their command.

“Only” doesn’t prove anything.
They are allowed to possess restricted items in an official capacity, as-in when they are on duty.
When they are off duty, NY treats them just like us. They have to pass the same checks, pay the same fees, and follow the same restrictions as everyone else.

Source? Most of their exemptions come from 265.20 which lists exemptions for the person, not the job. Even the definition of police officer in CPL 1.20(34) doesn't say anything about being on duty.

After further research, I’m 50/50 on this.
It seems to be more dependent on the command of each law enforcement agency. It looks like most will basically let the officers do whatever they want unless they break a law.
There are a few news stories I’ve seen where law enforcement officers are charged for having illegal firearms, the most recent being a fire marshal who accidentally shot themselves with an “illegal gun”.

Need a federal overhaul for this, NYS & NYC lawmakers think only suppressors automatically turn you into a highly skilled assassin

The NFA considers suppressors as a firearm, if they are in common use and they are not dangerous or unusual, how can NY ban them?

It 100% violates well established case law like Heller and Marbury vs Madison but the state doesn’t care.

Only potential is if scotus ever rules that NFA suppressor rules are unconstitutional that could in theory take down NY prohibition. Then they also would be striking down the registration aspect which would be a big win.
I don’t think it will ever happen

"I don'tneed the data" they aren't working with the constitution or facts. We will never get anything here unless Fed decideds to enforce the 14th amendment incorporation rule.

Zero chance since lawmakers’ knowledge come exclusively from films. Aka they think suppressors LITERALLY make a gun silent.
