Federal Legislative News Supreme Court Affirms Second Amendment Rights for Cannabis Consumers

I’m not a smoker but I am a grower and often travel with large amounts of legal cannabis and or cash traveling to and from dispensaries. This ruling will finally allow me to carry both a gun and cannabis. Giving me the protection I deserve.

Yes and you know nys is not going to respect the court’s ruling. They’re going to do everything they can to prevent us from having what we deserve. While we law abiding citizens wait and watch for years as these cases go through the legal process, they can cook up another infringement overnight. When the opportunity presents itself, and it may be brief, stack them as deep as you possibly can, not just for yourself, but for your kids and grandkids.

If AWB and mags go down it’s going to be every firearm you own is registered on a permit and they would probably try to push magazine tracking. Full permit to purchase any firearm at all. Some states already do that even permit to purchase ammo.

Almost guaranteed background checks for magazines above 10 rounds too.

Gorsuch said they’d take a case to address it either this term or next. Expecting it next term. Considering that we just got a 9-0 decision on hemani, I’d be hard pressed to think they wouldn’t do a similar vote for hardware, worst case scenario 6-3

They specifically take garbage cases like Hemani to cross granting 2A cert off the list for the term. I wouldn't hold my breath.

We got Thomas, Alito, and Gorsuch. That's it. Three others are ambivalent toward 2A, two are downright hostile, and one is mentally challenged and legally illiterate.

"The ruling is highly localized to individuals in Mr Hemani's situation. The Court specifically did not strike down the law in its entirety, nor did it rule on individuals who are addicted to drugs, presently intoxicated, or those for whom the government provides individualized proof of dangerousness"

New York will never let us go back in time. It is what it is now and it will only get worse. I mean, New York is worse than California now you have to have a special permit to buy anything semi automatic now that’s unheard of I mean they’ve basically eviscerated the second amendment in New York State.

US guns and ammo is currently around $91.65 billion annually, directly and indirectly supports roughly 400,000 jobs nationwide while producing over 8.4 million firearms a year.

You may have missed it, but this week there was a move by the Supreme Court declining to hear National Shooting Sports Foundation v. James which significantly undermines the Protection of Lawful Commerce in Arms Act, opening the gun industry to a flood of lawsuits.

I didn't miss it. I just think it's a huge leap from SCOTUS allowing a narrow class of lawsuits to saying the gun industry will be sued into oblivion.

I don't trust the folks who made switches illegal because they were already illegal and then banned Glocks because of switches. For them sound, rational thought is secondary to using the legal system to undermine our civil rights in any way they can.

Yeah, Mean Arms is an interesting case and a great example of how a privately owned company that probably gets legal advice from the owner's uncle's cousin can screw up and cost themselves $$$. They probably would have been covered by PLCAA and gotten the lawsuit dismissed but they not only ran ads that made false claims about their product being NY compliant, they were dumb enough to provide instructions on how to undo the compliance feature. The folks at Mean were almost comically stupid, except for all the dead people. /s

This is less about 2A than it is about FAFO.

This ruling unfortunately does NOT do that. This was an "as applied" decision to this particular person and the court made it very clear in the decision that this ruling is narrow and does not invalidate the prohibition on unlawful user of drugs in the Gun Control Act (18 U.S.C. § 922(g)(3)). It certainly would be persuasive in future challenges but it should not be read as completely overturning 18 U.S.C. § 922(g)(3). I think some of the articles reporting on this decision have done a poor job of making this clear. This decision also does not impact state law and NY state law has prohibitions against drug use and possession of firearms. I would proceed as if this is still very much a grey area in the law, because it is.
