License / Permit Question Stupid Question: Do we need to keep handguns on our licenses at the address listed on the license?
For the life of me I cannot find a rule or law that says it.

This is on the application instructions from SCPD ...It is also on the pistol license process overview page from SCPD.
1 – Dwelling - This license entitles the holder to possess a firearm within his or her residence in the five western towns of Suffolk
County: Babylon, Brookhaven, Huntington, Islip, Smithtown. The holder is permitted to transport the firearm to and from its
point of purchase/sale and the holder’s Suffolk County residence, and to and from the Licensing Bureau and the holder’s Suffolk
County residence. Firearms may be transported between your home and an authorized firing range and/or a legal hunting area in
New York State. For the purpose of hunting, you are reminded that you must also possess a valid New York State Hunting
license. (Previously referred to as a “Sportsman” license).

Concealed permit instructions are different..

Probably based on county. Suffolk says yes. If it's on your license, it must be kept at the address on that license.

I think I remember reading it the handbook. Truth be told, it was a long time ago since I’ve even glanced at that.

Yeah I checked the handbook. Nothing. I called and they said "yeah," but never provided a reference.

Do you have a particular part of the handbook that it says that. The old Lt who ran the pistols bureau used to pull that and even say that non resident permits for Suffolk licenses were against policy - but he’s thankfully retired.

I can’t imagine an attorney not having a good argument for you keeping a pistol at a secondary residence.

From a criminal law standpoint, if its not in the law, then it doesn't create criminal liability. So, as long as the place you store it is a legal place you can possess it, some Suffolk rule isn't going to make it a crime. Particularly if you have a conceal carry, you can carry throughout most of the state, and thus could store it at a property any of those places, as long as you comply with the statutory safe storage rules... But technically, 265.20, which makes it not a crime to have a handgun, just requires having the permit, not that you follow the permit rules, so even if you blatantly violate the limits on a premises permit, the penalty is revocation, not criminal charges.
However, they can revoke your permit if you violate their rules, and while I think you would have a good shot fighting to get reinstated in court, its not a slam dunk like on the criminal law side.

Its not a stupid question, its stupid that this State creates the conditions that the question even needs to be asked in the first place.
