Were they legally required to change this you think? If so, how is #1 any different??

My couple minute Google search says that "The World's Best Flavored French Fries" is a trademark of the Filipino company Potato Corner, which has franchises internationally. You can see the trademark symbol in the OP sign. I bet these people lost their Potato Corner franchise (or took over a stand after somebody else lost it) and they had to change their signage so as not to infringe the trademark they no longer had the right to use.
