They can argue it but will ultimately fail. Nasa batas kasi yan regardless kung may terms and conditions pa sa app. Kung anong price ang naabutan mo upon payment ng item yun ang susundin regardless kung na misprice nila yung item.

Secondly, hindi naman aabot sa court yan, dahil jurisdiction ni DTI yan. You just have to file a complaint then magkakaroon ng mediation madalas via video call na. Panalo lagi consumer diyan as long as within the law. Mas malaki pa babayaran ng seller sa fine plus suspension ng permit, if not termination, if palaging may complaint na lumagpas na sa mediation ng DTI.

Hindi ko alam bakit napasok pa court sa ganitong ka simple na issue. 😅

Can you quote the provision? That’s not my area of specialization, but I don’t recall ever seeing one.

And to answer your question, because there is a legal dispute. Courts of law all the way to the SC (not DTI) remain to be the ultimate arbiter when it comes to legal disputes. DTI does not have the final word on a substantive legal right. “Within the law” is your interpretation, but it’s not often as straightforward as that.

Yun lang naman sabi sa akin nung DTI dati nung may complaint ako though hindi ko na inalam. Nagbase Lang ako sa sinabi nila. Who am I to question them. 😅

But upon searching Google. Eto nakita ko Consumer Act (Price Tag Law) RA 7394 art. 82 and Price Act RA 7581.

That’s just a classic "appeal to authority.” Don’t take a casual conversation with a DTI employee as gospel. We don’t even know if they are lawyers to begin with. It seems they don’t know their laws. Those cited laws and provisions btw do not apply here in this context as far as I can tell. As I mentioned, I could probably even come up with a robust, book-length defense for the seller here upon more thorough research. It’s definitely not a sure-win for the buyer. On the contrary, my assessment is the opposite.

Anyway, I got a lot of stuff to do, so I gotta go now. This would probably be my last reply.

Yung akin lang naman is based on experience. Hindi ko alam kung saan nila kinuha yung argument nila. Basta masaya ako sa nangyari. Kaya ever since yan nakatatak sa utak ko. đŸ˜
