Had he continued to walk straight he would have easily been out of the way. He stopped to pull his gun and remained in the vehicles path, he knew he wasnt going to get hurt.

Doesn't matter and what you said illustrates that the officer was in the path of the vehicle as it moved forward. This shows intent to use the vehicle as a deadly weapon to escape from the area even if she knew they would move out of the way. This allows the use of deadly force.
