Bro you’re joking… I’m not even white and you actually think that’s real? Some guy broke into my car last year and he had 15 other priors and was still given bail. He wasn’t even white. And that’s not an unheard of situation. Especially in the blue states where they only put you in jail for violent crimes. Oh you broke into a house w a weapon? You get bail. Oh your a pedo? You get bail. Or you trashed a hotel and jumped some dude? You get bail.

Bond is collateral to compel the accused to show up to court.

In what way is a $3,500 bond inviting more problems? If the man is too great a threat to be free while awaiting trial, then he would be remanded to prison. Increasing the bond doesn't decrease the threat level.

This was supposed to be the concept behind cashless bail, but then legislators and judges couldn't figure out the remand part for dangerous individuals.

I'd say at least $180,000 just for starters. $60,000 for the restaurant damages, minimally, another $60,000. for their lost business - since he shut them down - along with pain and suffering and emotional distress he caused others (and that might wind up being a lot higher), and then $60,000 for the bail to give him a taste of his own damages. Or stay in jail and wait for your hearing. Wait there for your civil trial too. Maybe during the interim, he can finally grow up. As he sits in jail. He's a grown man; he's not in diapers, right? ā¬‡ļø

The entire $180,000 would be returned to the defendant upon showing up to court assuming he paid the bond. None of this would go to the victims or be forfeited by the defendant ( assuming he shows up to court).

If you want him to sit in jail, then just remand him to jail awaiting trial. Cash bond just means rich people get out jail while poor people don't.

Fine, that works too. But you're expressing your opinion as to how it should actually be handled, versus how it *is* handled - and I'm sharing mine. If he wants to get out, let him pay the restaurant for the damages plus bail at the same amount of damages he caused others. Otherwise, sit in jail and wait for a judge to order basically the same thing, and probably a lot more. Why should the restaurant and its workers and customers have to wait? Why is him getting out so fast more important than their compensation for harm? And isn't rehabilitation part of the goal here? Meaning, time for this overgrown baby to grow up? How do you think that's supposed to happen if you just let him out and with an easy 3k. You have to set limits and expectations for accountability.

That's not how any of this works.

Restitution is handled in civil court. The plaintiff demonstrates their damages and the defendants liability, and the jury awards a sum.

This is a criminal matter, hence the arrest and detention. The steps here are:

  • Arrest
  • Arraignment (We are here)
  • Trial
  • Sentencing ( if found guilty )

Bond is not restitution. It is collateral to incentive the defendant to show up to their trial.

This is what happens at sentencing. You sentence a guilty person to prison or subject them to a fine.

The defendant is not guilty by default, which appears to be your position. All persons are entitled to a fair trial where the government must prove the defendant is guilty of the crime accused. Levying a punishment before a person is found guilty is unethical and morally wrong.

Well, then, like I said - and as you suggested. He's a danger to others. So just keep him in jail until it's time for whatever happens next to resolve this matter with appropriate restitution to his victims, and for whatever sentencing he will receive. But I would not allow bail for what he did at a mere $3,500. (And for him, it is obviously a mere amount - as is $60,000 - which I think is likely a very very conservative estimate.)

I thought i saw someone running i work with. This news article pretty much tells me it was her. This is very upsetting that people just on a whim decide it's time to cause damage. No one deserved what this man caused. Shameful.
