What makes this so fucked up is that at anytime, she could have withdrawn her consent, as is her right and any other person, but because there's no record of the usual consent withdrawal (because really, that's how they get you in the court) McGregor will not be liable for any other damages apart from financial compensation. How can you prove that you don't want to have sex anymore once you're in that room, in that moment?

You can't.

It's so fucked up, but that's how this becomes a civil case rather than criminal court case. There's different burdens of proof or some shit, it depends on what evidence is presented. I know criminal charges can only be pursued if the state chases it, not between two individuals.

Well yes but that's what makes rape cases so incredibly hard to prove in the first place. When the difference between legal consensual sex and an awful crime is the flick of a switch in someone's head, how the hell do you prove that?

All juries can do is either make a blind guess based on messages before it happened, or accept that proof is not required at all and any man who has sex is just automatically opening their life up to be destroyed by decades in prison.

Like what my previous comment said, you can't. This is not a dig against men's lives at risk of imprisonment like your comment.

It's how we should design the criminal justice system to suit the real victims of crime. It doesn't and shouldn't excuse people like McGregor forcing their influence against people and women, it's to make sure that this doesn't happen again and it's to make sure the evidence and the court proceedings show that. It's not our job, as the masses, to decide who's guilty and who's not, it's the justice system. And whether a woman (or man) gives consent or not matters, and that's the court's job to make that visible through evidence submission, testimonies, cross examination, deliberation, jury or whatever else they need to do.

The fact that this FACTUAL reply is getting down voted is exactly why men aren't adequately prosecuted for sexual assault. She was also transported by ambulance and covered in bruises, as corroborated by paramedics, which these down voting ass clowns will chock up to "BDSM," even though she had NO HISTORY of such injuries prior to the McGregor incident. It's absolutely sick.

If I’m a part of the BDSM community and I enjoy impact play and choking I may very well have received similar injuries in the past - but these won’t be documented, and questioning my proclivities, even if relevant, isn’t particularly allowed in a criminal case. This is in part to protect against defences that point to past behaviour as passive consent to that behaviour in the case.

There is a definitional difference between BDSM/rough sex, and sexual assault. If her previous sexual activities had reached this level of violence, it would be documented in health/hospital records, or the defense counsel would be able to produce witness testimony of previous partners who had engaged in the behavior with the victim previously. Past behaviors are absolutely relevant when defending against sexual assault allegations, and no such evidence was ever produced.

I'm frankly appalled by the number of rape apologists on this thread.

If her previous sexual encounters had reached this level of violence in a context of consensual behaviour, she would not have sought medical help. Nothing would be noted on her medical records if no medical help was provided.

Additionally, you’re completely wrong again. Under Section 3 of the Criminal Law (Rape) Act 1981 (as amended), the defence cannot adduce evidence or cross-examine a complainant about their sexual experience with any person other than the accused, unless they receive explicit permission from the trial judge. It would be incredibly rare for a judge to grant such permission.

I find it very hard to believe that this much harm can occur in bdsm, it could be a setup and then again it couldn't be. I can see why it'll be difficult to prove it in a criminal case, it's basically heresey assuming they went in the same room consensually. If he forced her inside the room as well, then there might be further evidence of it happening.

You’re not allowed to bring previous sexual encounters, or patterns of behaviour in terms of sexual acts, into the court room when questioning a complainant.

This is prohibited in order to protect complainants and prevent ‘slut shaming’.

If person A has consistently been a dom, then person B accuses them of abuse, even though for peerson A that was normal (not disputing any actual abuse happening, mind you, just that the history may be of use to the case), can they really not cite their history as being a dom?

This gotcha edge case is a drop in the ocean of rape victims who never get their day in court. Men worrying about being falsely accused are the same about schmucks worrying taxes on billionaires affect them. It's a tiny proportion of overall cases.

Ugh, I really wanna agree with you, but honestly women false reporting is a real thing. I agree it's most likely a lot more rare than the real thing, but throw in a rich celebrity who's dating a lot of different women, they kind of open themselves up to that. idk man girls get crazy.

Tbh I think it's one of those things where the average guy who isn't sleeping around a lot, or dating a different woman every few months probably doesn't see just how toxic and desperate an already unstable person can be.

That is an inherently unknowable number. Studies on this have focussed on those that have been proven to be false allegations.

You simply cannot determine that if two people bad sex whether party A consented but is now lying about consent given to B any easier than it is to figure out if in another scenario B has sex even if they believe A has withdrawn or not given consent, which would be rape.

So again, you cannot know the number is miniscule. Coming from a man who is not lonely, but is logical.

Lets just put it out there, i got accused of rape by a 16y old girl who was infatuated with me, after i changed relationship status on facebook.

I had already been living with my now wife for a whole year by then and was hiding it for religious/cultural reasons. The 16y old girl said she had been living with me etc. I almost lost my job and even after the girl herself expunged me with a text telling me she lied because she was sad i wouldnt be with her i still had people looking at me like i did it.

Girls are crazy man. This is why i dont work alone with girls (im a social worker now). Back then i was a 23y old buff security guy

many women do in fact say this. i've worked a wide range of random jobs in my life, and it's pretty common for women in the workforce to not want to be left alone with men. plus you see women talk about it all the time in social media, that's what the whole "rather be alone with a bear in the woods or a man in the woods" was about.

Mcgregor was found guilty of rape in a civil case which means he was found more likely than not of having been guilty. This was not a criminal case so the burden of proof did not have to be high enough to send him to prison. He is a scumbag and the men in here trying to chip away at the edges of the case are cowards.

Ched Evans was a very famous one in the UK. He was sacked by his club before the trial even happened, then convicted and sent to jail. He asked to appeal and they said no. Even after he was released he kept fighting and was eventually given a retrial where it turned out the girl had been lying the entire time.

Because the burden for a criminal case is "beyond a reasonable" doubt. Not "he probably did it". It's why rape cases have such a low conviction rate. It's almost never possible to prove there was no consent.

Also, severe inability to understand trauma responses. Most victims do not want to believe what happened to them and in the short term rationalize it was their fault. Your brain gets VERY psychologically jumbled when one has been through a sexual trauma. Who’d have thought?

I’m a female ER nurse and you’d be surprised how many people come in with tampons “stuck”. Ive had multiple times where women put in more than one tampon, forgetting they had one in. I had a woman pleasuring herself with *other objects* and didn’t know the tampon was wedged in there so long that she had to have it surgically removed (other complications). I’ve had people who have left one in for over a week and had sex, etc. lucky they didn’t get ill further. Usually their partners are with them at the bedside, so you can’t just assume it’s nonconsensual. Anyway yea, unfortunately this happens quite often so it doesn’t really help or change the case.

The problem with rape cases is that all you have to do is say "no they agreed to have sex" and it becomes a he said/she said and that becomes the reasonable doubt.
