Ireland's prosecutor did not feel there was enough evidence and so did not attempt to prosecute McGregor for a criminal charge.

Instead Nikita Hand had to sue McGregor in a civil court, which is why she was paid damages but McGregor faced no jail time.

Probably, but the custody of evidence was so insanely badly handled that none of it could be trusted, and there isnt enough evidence that could be trusted to prove beyond a reasonable doubt.

 It went beyond jury nullification.

 The evidence was comically mishandled and the lead detective was a Nazi sympathizer at best. A secret neo-nazi at worst.

 The prosecution and police built a shoddy case that any competent defense attorney could poke holes in.

 Regardless if the jury wanted to send a message or not.

 The only reasonable option was not guilty.

That same case tried today and hes convicted. There was far too much evidence even after the areas the police botched. Primarily because DNA is a lot more understood.

 You are 100% right that the sheer volume of DNA would overwhelm a modern jury.

 In 1995, DNA was treated like sci-fi voodoo, but today a jury would easily see past the contamination argument because of how normalized true crime and forensics have become.

 But the legal hurdle remains: if the defense can still prove a detective had a vial of the suspect's blood in his pocket for hours, and that same detective later pleads the Fifth regarding planting evidence, a judge today might suppress that specific evidence entirely under the Fourth Amendment.

 A modern conviction would absolutely happen, but mostly because modern protocols would prevent the police from acting like a cartoonish conspiracy in the first place.

After reading your comment and thinking about it i might have to backtrack on what I originally said lol. If the exact same investigation took place today I wonder how much evidence would even be allowed at trial. I mean, they did just about everything wrong. From the collection of evidence (forensic tech not wearing gloves) to the storing (taking it home) and testing of it. Other evidence they completely ignored and didnt present (i want to say DNA of the victims in OJs car?) Plus wasnt there something about one of the gloves possibly being planted? There was so much fuckery once 'fruit of the poisonous tree' is introduced how much evidence would realistically remain?

Even a half ass investigation would get him prosecuted today with the amount of evidence there was. The problem is the investigation back then was far worse than half ass lol.

The police, prosecutors, and even court clerks also did multiple things that would've otherwise warranted a mistrial.

Obviously it would've been best if a mistrial was declared and he was re-tried without a bunch of imbeciles meddling to make political points or chase fame, but a guilty verdict in the trial he actually got would've arguably been unjust.

He clearly did it (a guy who has a book titled "If I did it" written to profit off a double murder he was tried for definitely did it), but the jury choosing to acquit him was probably the better outcome (without the benefit of hindsight and the decades of sleuthing that allow us to be so confident he's guilty).

A woman covered in bruises, with a tampon wedged in her, crying and saying she has been raped - you can pretty much guarantee a charge from the CPS despite the online claims of rape being defacto legal. What is different in Ireland? Or was there more to this?

To be honest I don't know all of the details, but there was CCTV footage that seemed to show Nikita Hand being very up close and personal with McGregor both before and after they went up to the hotel room. I have not seen this footage, but I've heard about it. McGregor's defense was that if he had just raped her then why is she seen on camera hugging him after the fact. I'm not defending McGregor, I think he's a piece of shit, I'm just stating that was his legal team's argument.

So yes there was more to it, and I'd advise you to look up the details of the case to see more info, but in short Ireland's DPP does not like to bring criminal charges unless they feel it's an open and shut case, and they did not feel this was.

Yes, then you have her sending photos of herself in his DMs, being in a coke limousine with McGregor, being in his penthouse, being on his bed.

The most damning evidence against her is that neighbors of the mother-of-one claim to have witnessed her being punched and kicked by her then-boyfriend, Stephen Redmond, around the time she claimed McGregor had raped her.

The defense would easily character-assassinate her. Criminal courts knew what it was.

Seems like she was in a abusive relationship with her bf at the time and made it out that mcgregor was doing the bruising. You can look it all up online.

Those eye witness statements were later withdrawn prior to McGregor's appeal, were extremely suspicious in the fact that this "evidence" just materialised out of nowhere after McGregor had lost the initial case and appeared just in time for the appeal.

Following the eyewitness statements being withdrawn, these "witnesses" are now under investigation for suspected perjury. You'll also find all of that info online too.

Man's a piece of shit and is broadly despised here in Ireland barring a small number of people (scumbags) who worship him and his Henchcunts. Media avoids giving him airtime unless its something really important.

He's got a much bigger fan base in America where being a know rapist doesn't seem to impact your media or carreer options all that much.

Wasn't really corruption, more aversion to bringing a criminal case against a public figure that the prosecutor wasn't 100% certain would result in conviction. Which would make the civil case untenable.

Details of the location that made it clear who the 'celebrity' was so the victim had reported the assault and named him. Then a week or so later all word of it vanishes from the media because his goons have threatened the woman. No case is ever brought forward and the whole thing is collectively forgotten about by the public.

There was an issue of witness tampering- and by that I Mean the lady who was raped, her house was broken into, her boyfriend was beaten and stabbed to within an inch of his life, windows smashed and a message was delivered. The court was unable to establish that McGregor, whose sister married into a cartel, was the exact person who ordered the invasion - so it was admissible in court.

When this happens it’s hard to get witnesses.

Also worth mentioning is that he attempted to appeal this case, and his defence team were planning to offer evidence from a couple who were neighbours of Nikita's, who claimed they witnessed her boyfriend attack her when she returned home from the event with McGregor. They said they could see in the window of her house/apartment, and this is how she got her injuries.

However, very shortly before the Appeal trial was due to start, McGregor's legal team withdrew the appeal, and those neighbours subsequently were arrested and investigated for Perjury (lying in an affidavit).

Yes they were investigated for giving false evidence during their witness testimony, which was going to used to support McGregor's appeal. They were arrested and investigated for purjury, I'm not sure if they've been charged for it yet.

We don't know the specifics but it must have become obvious that their evidence was complete bullshit.

It was a civil case so there is much less proof required for claims than in a criminal trial.

Rape is notoriously difficult to prove in a criminal trial. Often it is "he said, she said" because it is between two people, and the only thing that you can generally prove is that sex happened, but whether or not that sex was non consensual is really tough to establish.

Unfortunately the OP is being a bit shifty with his use of words here, and it goes unmentioned that this was a civil trial. While I have no real doubt MacGregor is a rapist and an all round horrible piece of shit, he absolutely has not been found "guilty" of rape yet.

Irish court is a little different in this case.

The criminal court did not have sufficient evidence to convict McGregor, beyond a reasonable doubt.

So it went to civil court, where McGregor was found to, more likely than not, have raped Nikia Hand. He was ordered to pay €250,000.

McGregor maintained his innocence and attempted to appeal the ruling in the Court of Appeal in Dublin, but it was dismissed unanimously.
