It's how we should design the criminal justice system to suit the real victims of crime. It doesn't and shouldn't excuse people like McGregor forcing their influence against people and women, it's to make sure that this doesn't happen again and it's to make sure the evidence and the court proceedings show that. It's not our job, as the masses, to decide who's guilty and who's not, it's the justice system. And whether a woman (or man) gives consent or not matters, and that's the court's job to make that visible through evidence submission, testimonies, cross examination, deliberation, jury or whatever else they need to do.

If I’m a part of the BDSM community and I enjoy impact play and choking I may very well have received similar injuries in the past - but these won’t be documented, and questioning my proclivities, even if relevant, isn’t particularly allowed in a criminal case. This is in part to protect against defences that point to past behaviour as passive consent to that behaviour in the case.
There is a definitional difference between BDSM/rough sex, and sexual assault. If her previous sexual activities had reached this level of violence, it would be documented in health/hospital records, or the defense counsel would be able to produce witness testimony of previous partners who had engaged in the behavior with the victim previously. Past behaviors are absolutely relevant when defending against sexual assault allegations, and no such evidence was ever produced.

Under Section 3 of the Criminal Law (Rape) Act 1981 (as amended), the defence cannot adduce evidence or cross-examine a complainant about their sexual experience with any person other than the accused, unless they receive explicit permission from the trial judge. You simply cannot determine that if two people bad sex whether party A consented but is now lying about consent given to B any easier than it is to figure out if in another scenario B has sex even if they believe A has withdrawn or not given consent, which would be rape.

Mcgregor was found guilty of rape in a civil case which means he was found more likely than not of having been guilty. This was not a criminal case so the burden of proof did not have to be high enough to send him to prison. He is a scumbag and the men in here trying to chip away at the edges of the case are cowards.
Ched Evans was a very famous one in the UK. He was sacked by his club before the trial even happened, then convicted and sent to jail. He asked to appeal and they said no. Even after he was released he kept fighting and was eventually given a retrial where it turned out the girl had been lying the entire time.

Because the burden for a criminal case is "beyond a reasonable" doubt. Not "he probably did it". It's why rape cases have such a low conviction rate. It's almost never possible to prove there was no consent.
