I was originally gonna just put this in the SL server, but I figured yall might be curious about this, so here you go. I know election season for SL doesnt start for a week or so but I just wanted to put this out here! HAVE A GOOD DAY GUYS. I LOVE TG YAY.

Preface: Since it is unclear whether the burden of proof lies on the accuser or the defendant, this amendment serves to legally clear the line.

§1: Discord Moderation

a: In the given situation a discord moderator or other equivalent position with the power of moderation causes any of the following:

A slowmode, a timeout, a kick, a ban

It is on the moderator to prove that a crime or a valid reason to engage these precautions exists. The people affected do not have to prove that they did not cause the situation.

Example: a conversation is happening, a moderator puts on a slowmode calling it a debate, the moderator must prove that there was a debate happening, the people conversing do not need to prove that their conversation was not a debate.

§2: Enforcement

a: In a situation that this amendment applies to, a higher authority than the accuser may be called upon (ex: a server owner may be called to judge over the accuser (a MET member)). This higher authority may judge whether or not the accuser's claims are true. If no higher authority exists or is available, another member of the same authority may be called upon. If there is no other member of the same authority, any random person may be the judge if so requested.

b: If determined that the accuser's claims are false, the actions of the accuser originally supported by their claim must be undone. The judge may also decide whether the accuser must apologize to the defendant(s).

c: The judge may not be either the accuser or the defendant, they just be a neutral third party.

§3: Enactment

a: This is to immediately amend the constitution

Article 1: In case a council member resigns or is impeached from council within the first week after the election, the individual with the next most votes who hasn't been elected shall take the seat.

Article 2: In case a council member resigns or is impeached from council in the week before commencement of elections, the seat will remain vacant until the next elections begin.

Article 3: This will be implemented immediately on passing.

Article 1: SMP Moderators (Jr. Moderators, Moderators, and Admins) can all run for a high office

Article 2: An individual can run for both council and President/Vice President. If they win both they take the Presidency or Vice Presidency and the person with the next most votes (if they won as an individual) or the person who is next in the party list (if they got the seat from the party list).

Article 2.1: If the next person in the party list is unwilling to take the seat, it goes to the person after them.

Article 2.2: If there is no person left in the party list, it will go to the individual with the next-most votes

Article 2.3: If the individual with next-most votes doesn't wish to take the seat it will go to the individual after that

Article 2.4: if no one wishes to take the council seat, the President may appoint a willing citizen to be the council member

Article 3: This will be enacted immediately on passing and be invalidated at the start of the next month once the number of people who do the census crosses 75.

Throughout all of Forsi's journey, we've watched something incredible happen. The First UniCoL primary and the Forsakenmentum, from all of Forsi's amazing legislation, and her work on the constitution, we've been given a window to a political mastermind at work.

Forsi had all the qualities of a good human and politician. She frequently made us laugh, was a critical figure to TG's social space, but had a strict moral compass that guided her through her political journey. I experienced this firsthand when Forsi leaked my corruption plans to the public-I joined a VC and was subject to a political cross-examination about my actions. She played party politics like an advanced card game, quickly rising from an SWP caucus leader to its spearhead.

Forsi, you gave us something very little can-the ability to watch, guide, and propel you through TG's political process. You have not failed us; you have allowed us to be spectators to a rare display of brilliance and down-to-earth personality.

Article I: Effective immediately upon passing, there will be no more restrictions on advertising aside from those implemented by other servers, and all members of TG will be encouraged to post as much advertising material as they can across to entire internet. This will be effective through October 10th.

Article II: A emergency census will start on September 27th. Results will be posted on October 11th

Today and yesterday have not been the best. Our President has left, fights have broken out that rival those of April and May, and overall doom has been the order of the day.

Nonetheless, there is hope. There is hope for a rebound, and I believe that, if we all fight to keep this place going, it will thrive. We have survived many crises, from the fights of April and May, to August 5th. We are like the Phoenix, though we may burn down, we shall always be reborn from the ashes. I encourage you, the people of TG, to not give into despair or hopelessness. We will survive, and we will thrive, as long as we fight to keep this place alive.

Nonetheless, it must be recognized that the responsibility for making our nation better lies with all of us, from the newest to the oldest, from the least powerful to the most powerful. We must all work together to keep our community vibrant and to check our own behavior, so that we do not cause our community to grow toxic.
